interest. Underwood, who claims to be
a British subject, was extradicted from
Canaria for murder. On this charge ho
was noquitted, but immediately after-
ward and before being released from
custody, ho was tried for highway rob-
bery anil convicted.
At the request of the British ambasa-
dor, the department of state at Wash-
ington, has written to the governor
calling his attention to a former deci-
don of the United States Supreme court
which is to the effect that a man must
be tried on the charge for which he was
extradicte and no other. In this in
stance the governor has no authority to
act and Underwood's friends have taken
the, proper course by applying for a
writ of habeas corpus.
