copies of same to the secretary of
the Board of Water Engineers as

The provisions of this irrigation
law will be carried out by a board
of water engineers to be composed
of three civil engineers, having tech-
nical knowledge as well as practical
experience, and skill in the science
of irrigation, one to be appointed
by the Governor from each of the
following districts or divisions. All
that portion of the state lying north
of the 29th parallel of latitude and
(west of the 100 meridian of long-
titude is District No. 1. The north
boundary line of Maverick county is
within a few miles of the 29th par-
allel of latitude and the east boun-
dary of the same county is very near
to the 100th meridian.
All that portion of the state lying
west of the 97 th meridian of longti-
tude and south of the 30th parallel
of latitude constitutes District No.
3, which the balance of the state is
comprised in Water District No. 2.
While the office of the board of
water engineers and the secretary’s
station shaH be in Austin it may
hold its sessions at any place in
the State deemed necessary.

lic inspection a record of all watr
appropriations as well as maps and

Appeal from my decisions of the
i board may be taken to the district
court of the county in which the
appropriation is sought to be made.
After this law goes into effect
and the year allowed for recording
appropriations has expired the use
of water without permit is forbid-
den and parties convicted of in-
fringement may be lined and also
become liable to the State for dam-
ages.
The board of engineers will meas-
ure the flow of all streams, make
surveys and collect data, determin-
ing the most suitable locations for
dams or other works, locate and
measure the lands best suited to ir-
rigation, examine and survey reser-
voir sites and make estimates of the
cost of proposed irrigation projects
and of the improvement of reservoir
sites. They shall also collect infor-
mation and stastics in reference to
the needs of the state concerning
irrigation and the storage and con-
servative of water for other pur-
poses, all of which together with all
other date collected shall be sub-
mitted to the governor in bi-ennial
reports.
Any appropriation of water wilful-
ly abandoned for three successive
years may be declared forfeited and

When trying to solve some of the
annual causes of eggs not hatch-
ing. the question of keeping them
previous to the time of incubation is
often brought up. In 1908 a Farm
and Home writer carried on an ex-
periment at Cornell university on
this phase, and the following were
the results.
Six lots of 50 eggs each were
kept one, seven, 14, 21, 28 and 35
days, respectively, in a suitable place
and handled in a supposedly proper
manner. The fertility and hatch-

tion to the number of days kept.
The longer the eggs were kept the
poorer they hatched, running from
8u per cent for fresh eggs to 8 per
cent for those 35 days old.
Three lots of 50 eggs each were
kept 14 days. One lot was packed
in bran, one in an ordinary eggs
case and one in a rotary egg holder,
allowing free circulation of air, and

Those turned every day did the
best, hatching 21 per cent more
chicks than those not turned at all.
Three lots of 50 eggs were placed
on the side, little or large end, for j
14 days. Every day the cases were
turned over for five minutes, and
then placed in the original positions.
The fertility proved practically the
same, and the hatchability of the
eggs kept on the large end was 8
per cent better than either of the
others, which produced exactly the
same results.
Three lots of 50 eggs each were
kept two weeks in an average tem-1
perature 65, and 50 degrees. The
percentage of the fertility ran 24, |
88 and 90, and the hatch was 4, 43
and 70 per cent fro mthe different
lots. This seems to clearly indicate
the necessity of keeping a room for
eggs at least as low as 50 degrees
in temperature.

All owners of land contiguous to
any canal and who have secured a
right to the use of water in said
eanal shall be entitled to be sup-
plied with water from such canal
in accordance with the terms of
their contract.” If, however, the
owner of the contiguous land and
the owner of the reservoir or canal
fall to agree upon a price for a per-
manent water right or for the use
or rental of the necessary water to
irrigate such land, then the owner
of the reservoir or canal if there
is any surplus water not contract-
ed to others must furnish the neces-
sary water to such contiguous land
owner to irrigate his lands “at such
prices as shall be reasonable and
just and without discrimination.”
Under the provisions of this law
any water right shall be an ease-
mentito the land that it irrigates
and shall pass with the title there-
to and the owner of the land shall
always be entitled to the use of
the water on the terms specified in
the contract with the irrigation com-
pany or water owner or in case of
no contract then at just and reason-
able prices.
If any person or corporation own-
ing or controlling any dam, reser-
voir, canal or other water supply
fails or refuses to furnish water
to any person entitled to receive it,
the aggrieved party may present his
petition to the board who after due
notice shall hear and decide the
case on its merits and in view of
the evidence produced, provided of
course that there is a sufficient sup-
ply of water available not contract-
ed to tohers. Appeal from the de-
cision of the board may be taken in
the manner provided for other ap-
peals.'' ' i
Any water company shall have the
right to publish its reasonable rules
and regulations relating to the
method and manner of distributing
the water, prescribing the time of
making applications for water and
of payment therefor.
Deeds and conveyances of irriga-
tion works shall be executed and re-
corded in the same manner as con-
veyances of real estate.
Interference with headgates or
water boxes; injuring or destroying
any dam, ditch, flume, pump or oth-
er property; and throwing dead ani-
mals or garbage or otherwise pol-
luting the waters of any canal, are
all made misdemeanors and are pun-
ishable by fines or county jail
terms.
Where irrigation ditches belong
to two or more persons and one
partner or shareholder fails to pay
«for or perform his proportionate
share of work necessary for the op-
eration and maintenance . of said
ditch, the others may proceed to do
or cause to be done" said work and
recover from the defaulting share-
holder the reasonable value or ex-
pense of such work so done.
Surplus water diverted from any
stream and not used by the appria-
tor must be conducted back ot the
same stream.
Persons or corporations proposing
to construct irrigation works are
permitted to make preliminary sur-
veys and are given free right of
■way over all public, school, univer-
sity and asylum lands of the state.
Private lands needed for canal right-
of-way, pumping plants or storage
reservoirs may be obtained by con-
demnation as provided in cases of
railroads, water' rights already in
use being exempted from condem-
nation.
All viaducts, culverts or siphons
necessary in the construction of any
canal shall be constructed and main-
tained by the owner of the canal.
Taking or diverting the water
from one stream or water course
into another one is prohibited un-
less by special permission of the
board granted after due hearing of
all interested parties.
Unless dams, reservoirs and ditch-
es are fenced in no action can be
taken by the owners for therpass
thereon.
Irrigation companies may acquire,
hold, improve, subdivide and sell
lands and other property but all
such lands except those on which
the works are situated must be dis-
posed of within 15 years.
Irrigation companies shall have a
preference lien superior to every oth-
er lien upon the crops for rent of
