this Ordinance.
SECTION III—Upon receipt of such

shall cause an inspection to be made
of the premises where and the equip-
ment with which such applicant car-
ries on, or intends to carry on, the
business for which a Permit ia
sought, and it upon such inspection
it is found to the satisfaction of
said City Health Officer that such
premises, including all buildings,
rooms or places, and the equipment
used or.to be used by the applicant
in the prosecution of his, her. or
its business, conforms to the food
and sanitary law. of the State of
Texas, Ordinances of the City of
Amarillo, the regulations of the
Board of Health of the City of Ama-
rillo. and all official orders pursuant
to said laws, ordinances, and regula,
tions, or if said premises or equip-
ment do not cenform, but upon no-
tice to that -effect by the City
Health Officer to the applicant, shall
be made to conform, then the City
Health Officer shall cause a Permit
to be issued to such applicant, con-
ditional upomt the iaithful observance
of said laws, ordinances, regulations
and orders, by said applicant during
the period for whieh the Permit
Ie sought. Such Permit may be re-
newed M upon application for such
renewal on a form furnished by the
City Health Department, it is found
that the appiicant’s piece of busi-
ness and equipment conforms to the
requirements of said regulations,
ordinances and laws and official or-

tion of the City Health Officer.

hereunder shall expire on the 30th
day of April, irrespeetive of the date

immersed, for at least one minute, in
clean water to which has been added
a solution of Hypo-Chlorite, Chlo-
ride of Lime or other disinfectant
approved by the Health Officer ,
which, has been prepared according ;

container in which the disinfectant

said disinfeetant in the rinse water

tion I. hereof, in violation of any
proviaion of any section of tbie Ordi-
nanee, ahall, upon conviction there-
of, be fined not lee* than Ten ner
more than TWO HUNDRED DOL-
LARS.
Section XVI. Any person, firm,
corporation or employee, who ahall
violate any provision -at- any sec-
tion of thie Ordinance,"shall, upon
eonviction thereof, be fined not leee
than TEN nor more .than TWO
HUNDRED DOLLARS.

that fresh fruit, such as apricots,
peaches, plums, cherries, grapes,
berries and fruits of a similar char-
acter, shall be classed as food not
commonly peeled or cooked before
consumption, and dujied figs, dates,
and raisins, shall be classed as foode
which ar* not usuaily cooked before
consumption; sausage, ham, and
boiled, smoked, dried er piekled
* meats or fish, bacon, cheese, pickles,
sauerkraut, cantaloupes and water-
mellons when sliced, dried fruits and
foods of a similar character, unless
the name are entirely enclosed by
a permanent protecting fly and duat-
proof covering, casing, or container,
consisting of eanvas, heavy wrap-
ping paper, glass, wood, fiber or
other suitable end similar material,
shall he classed as foods which are
required to be protected at all timee.
(B> Th* protection which shall be
considered adequate for food kept
outside of buildings or in the open
air or enclosed, roofed structures or
wagons or other vehielex, shall be a
complete enclosure of a fixed or
permanent character, consisting of
glace, Wood, or sheet metal, or ma-
terial of a similar character which
ie imperrable so as to protect
against flies, dust, dirt, vermin, rata,
mice, doge, cats, promiscuous hand-
ling and other contamination; pro-
vided, however, that in the case of
fruits, bakery goods or other foods
subject to sweating when completely
enelosed, openings may be allowed
on two sides of the enelosure re- ■
quired, which openings shall not ex-
ceed ten per cent of the area of each
side*, end which opening shall be
completely covered with twenty
mesh screen or material of a simi-
lar character; and provided, further,
that covering the top and all sides of
a container with paper, cloth, can-
vas, tarpaulin, or material of a simi-
, lar character shell be considered an
adequate covering for food while
being conveyed or transported in
vehicles.
(C) The original box, crate or
container and the usual cover for
such container, left in place and in-
tact, ahall be considered adequate
protection for fruits sold or offered
for sale in such original containera
provided sueh fruits are protected
from dust, dirt, flies, vermin, rate,
mice, dogs, cats and promiscous
I handling.
(D) A complete enclosure in a
box, carton, wrapper or package of
similar character shall be consid-
ered adequate protection for all

BUILDINGS
SECTION VU. -Tha term “Food”
or “Foodstuff" as used in this Or-
dinance shall mean and inelude any
article used for human consumption

mixed, or compounded. The term
"Food handling Establishment" shall
mean and include any factory, store,
hotel, restaurant, luneh room, cafe,
soda fountain, ice eream parlor, ve-
hide, cart or other place where
foods ate stored, manufactured, pre- '
pared, transposed, handled, sold,
offered for sale or given away for
public consumption.
. ’ Every place, enclosure, vehicle,
wagon, house, building or room used
—as a food-handling establishment in
the City of Amarillo shall be con-
structed OE re-const ructed so aa t4
conform, to the following require-
ments:
(A) All floor*, wall or ceiling*
shall be ef tight, sound material
consisting of wood, metal, tile, con-
ereteer material of a similar char-
acter which can be easity cleaned.
(B) All doors, windows or other
openings which might permit the in-
gress of flies shall be covered with
tight-fitting, sound wire-screening of
not less than fourteen meshes to the
inch, and all screened doors shall be
equipped with suitable self-closing
devices.
(C) All rooms or pieces used for
the preparation, handling or display-
