and pay for first class work and material for all parts of said improvements, and agrees tc
complete same according to said plans and specifications and to deliver same to owner

soil in and upon which the owner directs said improvements to be constructed is inadequate
to support and sustain them without injury to them; and contractor agrees to furnish
account of owner, and any taxes or insurance premiums so paid shall from the date of
Payment constitute a debt against owner for the amount so paid in favor of the holder
of said note, which debt shall bear interest from the date of the respective payments
at the rate of 7% per annum, shall be subject to a 10% attorney’s fee in like manner as
is provided for in said note, and its repayment shall be secured by the mechanic ‘s lien
herein granted; and owner agrees that if default be made in the payment of said taxes
and specifications, and also except any damage, if any, which may be caused because the

for materials or labor used in constructing said improvements.
3. In consideration of the performance by contractor of his said agreements, owner
agrees to pay to the order of contractor $2,650.00, in accordance with one certain
of date October 28, 1936, of record in Book ”549", pages 582-583, Deed Records of
Travis County, Texas, to which said map or plat and said deed, and the records thereof,
any damage which may be caused by defects, if any, in, or inadequacy of, said plans
promissory note, executed by owner, of date August 28, 1940, for the sum of $2,650.00,
payable in installments as follows: one installment of $75.00 or more shall be paid
on the 15th day of October, 1940, and a like installment shall be paid on the 15th day
of each month thereafter until it is fully paid and satisfied. Each installment payment
option of the holder, mature said note, and the holder may then, at his option, immediately
institute suit to collect same and to foreclose the mechanic’s lien herein given to secure
its payments, and also provides for 10% attorney ‘s fees, if placed with an attorney
for collection after maturity, or if collected by legal proceedings of any kind, and
that in no event shall such attorneyTs fee be less than $50.00. Owner further agrees
that after said improvements have been completed according to said plans and specifications,
she will keep them insured, at her own expense, against loss or damage by fire, windstorm,
and hail to the extent of the full insurable value thereof in some company or companies
shall be applied as of the date it is made, first to the interest accrued to that date,
and the remainder to the unpaid principal. Said note bears interest from the 23rd
day of September, 1940, until paid at the rate of 7% per annum, and provides that all
past due interest shall bear interest • from its maturity until paid at the rate of 7%
