default, to bring suit to collect said note, and all other sums which may become due
under this contract, and to foreclose the mechanic’s lien herein g ranted.
4. Owner hereby gives and grants to contractor, and the parties hereto agree that
contractor, his heirs and assigns, have a mechanic’s lien upon the above described

That W. H. Dittrich , as party of the first part, and Floyd Raymond and wife,
Mildred T. Raymond, parties of the second part, all of Travis County, Texas, have this
day made, and entered into the following agreement and contract, to-wit:
Whereas, the parties of the second part are desirous of building a one story, frame,
5 room shingle roof house, with garage detached, according to the plans and specifications
signed by the parties hereto and made a part of this contract on the property belonging
to and claimed by them as their homestead, situated in the City of Austin in Travis
County, Texas, and more particularly described as follows:
All of Lot No. Eighteen (18) in Block Twenty three (23) of Rosedale "Fw, a subdivision
of 6.44 acres out of the George W. Spear League in Travis County, Texas, as shown on the
appeared Maude Yates, Guardian of the Estates of Forrest John Cherico, Felix William
Cherico, and Martha Marie Cherico, Minors, known to me to be the person whose name is
subscribed to the foregoing instrument, and acknowledged to me that she executed the
same for the purposes and consideration therein expressed, in the capacity therein
stated.
