part, all of Travis County, Texas, WITNESSETH:
That the said party of the first part, for the consideration hereinafter mentioned,
agrees and binds himself well and truly to construct, erect, finish and complete and

the foregoing instrument, and acknowledged to me that he executed the same for the
purposes and consideration therein expressed.

whose names are subscribed to the foregoing instrument, and acknowledged to me that they
each executed the same for the purposes and consideration therein expressed, and the
said I elma Jordan wife of the said Roy Jordan, having been examined by me privily and
apart from her husband, and having, the same fully explained to her, she, the said Velma
Iordan, acknowledged such instrument to be her act and deed, and declared that she
had willingly signed the same for the purposes and consideration therein expressed,
and that she did not wish to retract it.
3. It is expressly agreed and understood that if for any reason said improvements are
not completed by party of the first part according to plans and specifications, that
then and in such event there shall be due party of the first part, his assigns or other
holder of said note a sum equivalent to the value of the work and materials furnished,
said sum to be arrived at by deducting from the total contract price the amount needed
to pay for completion of said improvements according to said plans and specifications
and the difference to-wit; the difference between the total contract price and the cost
of completion to be the amount due party of the first part or his assigns and in such
event the mechanic’s lien shall exist for the benefit of any holder of said note to the
extent of said amount, and this stipulation shall enure to the benefit of any subsequent
holder of said note, such other holder to have the further option of completing the con-
tract according to plans and specifications in which event the total amount of this
