Alvin City Council heard a
plea from a local fireworks ven-
dor who was discovered to, be
operating illegally near Alvin
city limits.
The vendor claimed ignorance
A single charge made in an ethics complaint
against Councilman Dick Tyson was rejected
because he did not say "yea" or "nay" at a
March 4 Council Meeting.
The complaint, refiled by former Council
Member John Ralph on June 7, reasserted a
charge that Tyson violated ethics rules by
an open beer bottle in the center con-
sole of the car, as well as another
unopened bottle in the seat. The pas-
senger also had red, glassy eyes,
slurred speech and the odor of alcohol
on his person, according to the report.
Police found from contact with those
speaking to the Council as a private consult-
ant on behalf of the developer of a housing
project.
Ralph stated in the charge that Tyson admit-
ted a conflict of interest concerning the
development, yet continued to be involved in
the issue by "using his position as a Council
Member to address the Council without sub-
mitting written petition to speak, as is
required by the public."

to a residence. Due to recent bur-
glaries in the area, the officer made
contact with the subjects, two
females and one 16-year-old male.

dents to a ride and lunch on July I. Jaylon Rhodes and Anthony
Brumfield were picked up by the department’s Hummer and
taken to CiCi's Pizza, which treated the kids to free lunch.
Rhodes and Brumfield had won the lunch at a drawing at school
during a Bike Safety Program.

In a June 25 letter to Ralph sent by Larry
Boyd, attorney for the Board of Ethics and
Compliance. Boyd wrote that the charge did
not comply with the form requirements of an
ethics violation, because Tyson did not partic-
ipate in a vote.
According to Boyd. Alvin’s City Charter
"prohibits participation in a ’vote or decision’
in which the Council Member has a conflict
of interest.

• A drive-through incident lead to the
arrest of two teens on June 27.
Police responded to a local restaurant
in response to a call of a conflict at the
drive-through. Officials said the offi-
cers found the suspect vehicle at the
exit of the parking lot and stopped it.
An 18-year-old male was driving the
vehicle, and a Id-year-old male was in
the passenger seat. An officer observed
"This Charter section does not state that it
applies to participation in a discussion."
Boyd went on to write that the Texas Local
Government Code, not Alvin’s Charter, pro-
hibits participation in a discussion as well as
a vote when a conflict of interest is present.
However, as the Board is determining the
complaint solely by Alvin’s Charter, the com-
plaint was returned to Ralph.
