'____NOT GUILrYr This ver-
dict which no doubt seems strange
to the average reader, is explained
in the record in the following
manner.
Of course, it is evident to all that
Wenz was a crude, callous indi-
vidual. to go to such extremes as
he did to collect the debt of $35.
and a gambling debt at that. But
the whole case and the resultant
verdict, seemed to hang between
the two larcenies, "petit" and
■■grand."
He was convicted in the lower
Court of grand larceny, which is a
felony, and was sentenced to two
years in prison. He appealed to the
higher court, who reversed the,de-
cision. claiming that there is no
market for a second-hand coffin
The court said: “One recovers, not
what the property was worth to
him. but its value in the market.
This man can not be convicted of
grand larceny, for the statute de-
clares that no one shall be adjudged
guilty of that crime, unless the
goods stolen were of the value of
ten dollars or more.”
Of course, the coffin was de-
clared to be worthless, of nomarket
value, and Herman Wenz won his
case in the Supreme Court of
Missouri. The record does not
state, but he was probably held for
"petit" larceny, which is only a
misdemeanor.
This is a true case. Reference of
citation may be had by sending a
stamped, self-addressed envelope
to "Bela Lanan-Court Reporter.”

OKLAHOMA CITY March 11 —
(P»—The houe had sent the beer
tax bill back to committee today
after hearing floor leader Murray
Gibbons warn such action would
virtually kill chances for a free
text-book law this session.
Earlier Friday the representatives
had voted, 45 to 35, to allocate $,-
000.000 a year of the beer tax reve-
nue to a free textbook purchasing
fund But in ordering the revenue
and taxation committee to redraft
the revenue distributing section,
that big allocation was * cancelled
automatically.
Herbert Branan, revenue commit-
tee chairman, left no doubt he
would seek to redraft the bill to
send the money to the general fund
in an effort to balance the budget
The house reversed itselr once on
distributing the beer tax money, but
stood hitched the second time The
MH was sent to committee by a vote
of 50 to 41, and Gibbons' motpon to
reconsider went down, 44 to 54 ' .
' The million dollar textbook fund
would have taken most of the beer
revenue, which Branan said was
only 51,050,000 last year.

Mickey Rooney as "Huckleberry
Finn" is making a big hit with a
host of the smaller children who
have attended the Paramount dur-
i ing the past few days, and the pic-
ture bids for a large cut of the
younger generation's business—in
opposition of the B house westerns
showing today—for' this matinee
and night.
Reason is largely because ‘of the
style of humor, such as that em-
ployed by Huck and the negro
slave Jim on their long raft ride
down the Mississippi river.
Mark Twain's whimsical and
sometimes unusual philosophy

same name hAs mostly been
removed, leaving the bare wit
of a minstrel show for these
dialogues. The kids eat it up.
"Huckleberry Finn" follows some-
what the same general outline of
the novel, but is pruned and re-
hashed m the Hollywood fashion.
