Property Tax Protest and Appeal Procedures
The law gives property owners the right to protest
actions concerning their property tax appraisal. You
may follow these procedures if you have a concern
about:
• The value placed on your property;
• Exemptions that may apply to you;
• Cancellation of agricultural appraisal;
• Whether you property is taxable;
If the appraisal district has appraised your property at
$1,000,000 or more, you must file a notice of appeal with
the chief appraiser within 15 days of the date you
receive the ARB's order.
More Information: You can get more information by
contacting your appraisal district at 1024 S. Greenville,
#120, Allen, Texas. You can also get a pamphlet
Which local governments should be taxing your describing how to prepare a protest from the appraisal
property; or district or from the State Property Tax Board, 4301
• You think the appraisal district has done something Westbank Drive, Building B Suite 100 Austin Texas
else that adversely affected you. 78746
Informal review: An owner or his authorized agent is
requested to contact the Appraisal District staff to
discuss and hopefully resolve any concerns that the
owner/agent might have regarding the appraised value,
or any other item listed above. The owner/agent and an
employee of the District will review the available
information to determine if a mutual agreement can be
reached.
Review by the Appraisal Review Board: If you can't
resolve yourproblem informally with the appraisal district ,
staff, you may have your case heard by the appraisal
review board.
The appraisal review board (ARB) is an independent
board of citizens that reviews problems with appraisals
and other concerns listed above. They have the power
to order the appraisal district to make the necessary
changes to solve problems. If you file a written request
for an ARB hearing (called a notice of protest) before the
deadline, the ARB will set your case for a hearing. You'll
receive written notification of the time, date, and place
of the hearing. The hearing will be informal. You and
the appraisal district representative will be asked to
present evidence about your case. The ARB will make
its decision based on the evidence presented. You can
get a copy of a protest form from the appraisal district
office at 1024 S. Greenville, #120, Allen, Texas.
Note: You shouldn't try to contact ARB members outside
of the hearing. The law requires you to sign an affidavit
saying that you haven't done so before the ARB hears
your case.
Review by the District Court: After it decides your
case, the ARB must send a copy of its order by certified
mail. If you're not satisfied with the decision you have
the right to appeal to district court. If you choose to go
to court, you must start the process by filing a petition
within 45 days of the date you receive the ARB's order.
Deadline for filing protests
with the ARB
(The deadline is postponed to the next business day if it falls on a
weekend or holiday)
Usual deadline:
Late Protests (ifyou miss
the usual deadline for good
cause. Good cause is some
reason beyond your control,
like a medical emergency.
The ARB decides whether
you have a good cause.)
Special deadline:
Change of Use (if the
appraisal district has
informed you that you are
losing agricultural appraisal
because you changed the
use of your land.)
ARB Changes (if the
ARB has informed you of a
change that increases your
tax liability and the change
didn't result from a protest
you filed.
On or before May 31 (or 30
days after a notice of
appraised value was mailed
to you, whichever is later).
Before the day the appraisal
review board approves
records for the year. Contact
the appraisal district for more
information.
Before the 30th day after a
notice of the determination
was mailed to you.
Before the 10th day after the
determination was mailed to
you.
If you believe the appraisal district or ARB should have sent
you a notice and did not, you may file a protest until the day
before taxes become delinquent (usually February 1). The
ARB decides whether it will hear your case based on evidence
about whether a required notice was mailed to you.
