WASHINGTON, Aug. 1.— Most
new railroad construction in thii
country is being done in Texas,
the Southwest generally, and in
the West, and proceedings before
the Interstate Commerce Commis-
sion illustrate that there la atiff
competition when the building of
a new line is at issue.
The newest illustration is that
offered in the controversy over
whether the Commission shall
grant the Abilene & Eastern Rail-
way Co. a certificate of public
convenience and necessity. That’s
the ICC way of saying permission
to construct a new line. The
Commission decides whether a
new line will afford the public a
convenience not heretofore avail-
able, and whether the proposed
construction is necessary.
The Abilene & Eastern wants to
built 43 miles of railroad from
Abilene, in Taylor County, to
Cross Plains in Callahan County.
Thomas F. Sullivan, an exam-
iner for the Commission, has al-
ready recommended that the per-
_ mission be given. But the Texas
& Pacific Railroad and the Abi-
lene & Southern Railroad are pro-
testing.
Colorful Protests.
These protests are not the dry,
colorless and highly technical doc-
uments one might reasonably ex-
pect to find directed to the ICC,
but, rather, that sparkle with the
firefire of competition.
The latest brief in the case,
filed this week, gives proof.
It is the reply of the Abilene &
Eastern and the chambers of com-
merce of Cross Plains, Waco and
Houston, to the protesting brief
filed by the T&P and the Abilene
—& Southern.—------------------
The brief says, in part:
“The protestants, since the ae-
quisition by the Texas & Pacific
of the Abilene A Southern, have
been in command of this territory
and they do not want the MKT
to have a share of the freight
which it will get if this line is
built. The protestant, the Texas
& Pacific, by purchase of the A&S.
put an end to the competition then
existing between it and the MKT,
and they are contesting the con-
struction of this line because they j
do 40% want such competitive ser- |
vice re-established.
Modern Don Quixote.
• “In fact, we would rather be-
lieve that this is the real motive,
because otherwise the president of
the protestant. who styles himself
'a big railroad man,' appears in
the light of a modern Don Quixote,
who, mounted on his chargers of
giant locomotives, and traveling
at the rate of 65 or 70 miles an
hour on 110-pound steel, valiantly
goes forth to save the honor of
the railroads from the contami-
nating influence of the milling in-
dustry.
"Is not the analogy complete
when counsel for the protestants
solemnly parade before this hon-
orable commission this asserted)
'promotion' by milling and grain
interets . . .?"
Protestants claim the territory
doesnot need another railroad
and, among other things, say that
the area to be traversed by the
proposed line needs trucks and
not a railroad. The A&E replies
that "evidence is that farm and
ranch dproducts moving from
points along this proposed railroad |
will not move by truck but will
move by rail, largely to its ulti-
mate destoination, the Gulfports.”
Houston, apparently, supports
the A&E, because the proposed I
line will open upnew territory for
the Southeast and will bring more
trade to its port and other Gulf
ports.
