To Assault; Gets $25 Fine
The trial of Jim M. Horrell,
11, on a charge of aggravated
assault ended at 4:30 p.m. in coun-
ty court Wednesday with Horrell
pleading guilty to simple assault.
He was assessed a $25 fine and
court costs.
Horrell was charged with me
Ing an aggravated assault with a
deadly weapon on Leon C. Bow-
man. former Abilene supervisor
for the Liquor Control Board and
now in Lubbock.
County Attorney Lee Sutton rest-
ed the state's case at 11:30 am
after offering testimony of three
witnesses. Judge Reed Ingalsbe
overruled Defense Attorney Davis
Scarborough's motion for an in
structed verdict ind recessed ur. 1
til 1:30 p.m.
No Testimony Offered
When the afternoon session open-
ed Scarborough announced there
would be no defense testimony of-
fered. Ingalsbe then dictated the
judge's charge to the jury. At-
torneys waited until 4:30 p.m.
for it to be prepared so they could
argue the case.
After a 3-hour wait, Scarborough
agreed for Horrell to enter a plea
of guilty to simple assault and
pay a $25 fine.

that he (Bateman) tapped Horrell
on the head with the gun Bowman
had taken from him.

Whitfield Davidson dismissed the
suit concerning Bowman.
