WASHINGTON, July 12 Q—The
Justice Department said today the
dual role played by Adolphe H
Wenzell voided the 1954 Dixon -
Yates private power contract, and
the government owes nothing for
cancelling it.
On this and other grounds, the
department asked the U.S. Court
of Claims here to dismiss the ac-
tion brought by the Dixon-Yates
interests, through Mississippi Val-
ley Generating Co., to recover
$3,543,778.45 from the government
The company claimed it had
spent that much on preparatory
work for a proposed 107-million -
dollar private power plant at West
Memphis, Ark., before the Eisen-
hower administration pulled out of
the contract.
The plant was to supply private
power to Tennessee Valley Author-
ity territory because of large with-
drawals of TVA power by the At-
omic Energy Commission for AEC
installations

i charges made before cancellation
of the contract that a ' conflict of
interest” was involved.
The department told the claims
court the agreement was "con-
trary to public policy unlawful,
and null and void” because Wen-
zell at the time the contract was
being drawn was a consultant to
the Budget Bureau in relation to
expansion of electric facilities in
the TVA area, and was also a sal-
aried vice president of First Bos-
ton Corp of New York City which
became financial agent for the
Dixon-Yates interests.

Stadium Manager
Makes Guilty Plea
AKRON, Ohio, July 11 u—wa-
Liam Andor son, 41, manager of
County Stadium to Milwaukee,
home of the Braves, pleaded guil-
ty today in Common Pleas Court
to embezzling $6,307 from the Rub-
ber Bowl in Akron.
He said he used none of the mon-
ey for his personal gain but spent
it promoting events in the bowl.
He managed it from February,
1949, to October, 1954, when he
was named to the Milwaukee job.
Judge Clande V. D. Emmons
gave Anderson a suspended sen-
tence and placed him on probation
for five years.
The American Bible Society dis
tributed 3,540,770 volumes of scrip-
ture in Latin America in 1955.
