KANSAS CITY, Mo. — A clinging zone press by West-
minster in the first half promoted a severe case of first-
tournament jitters for McMurry College Tuesday night,
and the Indians, though making a gallant recovery ef-
fort in the final 20 minutes, never could quite erase a
15-point halftime deficit as the top-seeded Titans eked
out a 59-54 first-round NAIA victory before a crowd of

AFL CONCLUDES CASE
NFL Files For
Suit Dismissal
BALTIMORE (AP) - The Na- of his unsuccessful efforts to ob-
tional Football League asked U.S tain an NFL franchise in Febre-
District Court to dismiss the $10
million antitrust suit filed against
it by the American Football
ary 1959, and his subsequent align-
ment with the new league in No-
League Tuesday.
The motion to dismiss was filed
after the AFL concluded its case
with testimony by William H (Bil-
lyh Sullivan Jr., president and
part owner of the Boston Patriots
Arguments on the motion will be
presented Wednesday before Chief
Judge Roszel C. Thomsen, who is
vember of the same year
Before Sullivan took the stand,
AFL attorney Warren E. Baker
submitted correspondence, con-
’ tracts and other papers as ex-
hibits. The documents included
items of television coverage, some
involving the failure of outlets in
many cities to telecast the AFL
ST LOUIS (AP) — Harry Gal-
latin, a bruising competitor in pro
basketball and highly successful
coach at Southern Illinois, was
given the job Tuesday of restor-
ing the St. Louis Hawks to their
former heights in the National
Basketball Association.
The 34-year-old former "iron
man” of the New York Knicks
hearing the case without a jury.
The three-page written motion
contends the AFL has failed to
prove. .during more than two
weeks of testimony, that the NFL
has the power to exclude compel
ing professional teams from ei-
ther local or national markets.
"Rather the proof affirmatively
shows there are sufficient cities,
facilities, players, television out-
lets and financial and other re-
sources, available to enable com-
peting leagues and the teams be-
longing to such leagues to enter
and continue in the field," the mo-
tion said
NFL attorneys also contend
games.
During a discussion on the rea-
sons behind such exclusions, NFL ,
attorney Gerhard Gessel argued
that the proof was "most specula-
tive."
Gessel said possibly some tele-
vision stations "preferred to show
Mickey Mouse instead of the
American teams wandering
around on the gridiron."
