PUBLIC NOTICE
Notice is hereby given that the following resolution was approved by the Lewisville
City Council at their regular meeting held on Monday, January 8,1996.
Section 2. That the Lewisville Public Improvement District No. 1 is hereby authorized
and created as a Public Improvement District under the Act in accordance with the
findings as to the advisability of the services and improvements contained in this
Resolution. The District shall be subject to all terms, conditions, limitations and
reservations contained in the findings of Section 1 of this Resolution.
Section 3. That the City Secretary is directed to give notice of the authorization for
the establishment of the District by publishing a copy of the Resolution once in a
newspaper of the general circulation in the City of Lewisville. Such authorization shall
take effect and the District shall be deemed to be established effective upon the
publication of such notice. The duration of the District is perpetual unless dissolved in
accordance with the Texas Local Government Code.
RESOLUTION NO. 2078-1-96(R)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF LEWISVILLE, TEXAS, APPROVING THE FORMATION
OF THE LEWISVILLE PUBLIC IMPROVEMENT DISTRICT
NO. 1 FOR WATERS’ RIDGE DEVELOPMENT.
WHEREAS, Chapter 372 of the Texas Local Government Code (the "Act") allows for
the creation of public improvement districts; and
WHEREAS, owners of real property located within the Waters’ Ridge Development
have delivered to the City of Lewisville a Petition (the "Petition"), attached hereto and
made a part hereof and marked Exhibit "A", to create a Waters’ Ridge Public
Improvement District No. 1; and
WHEREAS, said proposed District is shown on the map attached hereto and made a
part hereof and marked Exhibit "B" (the "Map of the District"); and
WHEREAS, the owners of more than 50% of the appraised value of the taxable real
property and more than 50% of the area of all taxable real property within the District
have executed the Petition in compliance with the Act, thereby authorizing the City
Council to consider the creation of the District; and
WHEREAS, after providing notices required by Section 372.009 of the Act, the City
Council on January 4, 1996 conducted a public hearing on the advisability of the
improvements and services; and
WHEREAS, the City Council adjourned such public hearing;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
LEWISVILLE, TEXAS:
Section 1. That pursuant to the requirements of the Act, the City Council, after
considering the Petition for the proposed District and evidence and testimony presented
at the public hearing on January 4,1996, hereby finds and declares:
(a) Advisability of the Services and Improvements Proposed for the District. It is
advisable to create the District to provide the services and improvements
described in this Resolution.
(b) Nature of the Services and Improvement. The general nature of the services
and improvement to be performed by the District is long-term maintenance of an
existing levee system. The District will use, operate, inspect, maintain, and repair
the Levee to enable the Applicants to reclaim from the 100-year floodplain real
property located within the District and within the City. The District is to
supplement services within the District, but not replace or supplant existing City
services provided within the District.
(c) Estimated Cost of the Services and Improvements. The estimated first year
budget costs are‘$38720 or $124.04 per acre of land within the proposed Public
Improvement District.
(d) Boundaries. The District is located wholly within the City of Lewisville, Texas.
The District is composed of 312 acres of land in Waters’ Ridge Business Park
(Phase I and II) and generally bounded by Bennett Lane to the north, Union
Pacific Railroad to the east, the southern boundary of the Waters’ Ridge Phase II
Development to the south and Lakepointe Drive to the west. The boundaries are
shown on the Map of the District and as stated in Exhibit "B".
(e) Mehod of Assessment. The method of assessment Tor the District will be
assessed” at number of acres of land on a dollars per acre basis and divided
equally.
(f) Apportionment of Cost Between District and Municipality as a Whole. All costs
will be apportioned 100 percent to the property located within the District.
(g) The findings set forth in the preamble of this Resolution are hereby found to be
true and correct.
Section 4. That the City Council will designate a Board of Directors to manage the
District. All policy decisions that affect the District shall require the approval of the City
Council of the City. The Board of Directors shall be composed of five members, two
members appointed by the City Council of the City and three members appointed by the
record owners of taxable real property that will be liable for assessment under this
Petition. If such record owners elect not to serve on such Board of Directors, the City
Council shall appoint any of such three members not so appointed by the record
owners.
Section 5. That the City Council hereby approves the five-year Service Plan made a
part hereof and marked Exhibit "C" (the "Service Plan"). The Service Plan covers a
period of five (5) years and defines the projected cost for services and improvements.
Expenses in the five-year Service Plan include an annual inspection, levee survey,
mowing and maintenance, erosion repair, removal of channel silt, liability insurance, a
maintenance plan, legal fees, the City’s administrative costs, and a contingency.
Expenses in subsequent years may include other types of services and improvements.
In addition, there will be an establishment of a one-year reserve in the amount of
$25,500, and, will be replenished in the next budget year if any of the reserve is used.
