MILITARY NOTES
Mrs. Pendleton’s family who live on
Government hill and were poisoned by
eating head-cheese last Thursday have
all recovered from the effects of the pois-
on. It is not known Low the cheese be-
came poisoned.
There was no drill at the military post
yesterday evening. It will be given this
evening.
The 23rd infantry band will give a con-
cert at Fort Sam Houston tonight
The soldier boys can’t play foot ball so
soon after pay day as yesterday. The
game was postponed until next Sunday
and the San Antonios played a practice
game back of Muth’s yesterday.
The post canteen at Fort Sam Houston
was closed yesterday. ■
A number of hunting parties were out
yesterday with the usual poor luck.
General Vincent left the city for Wash-
ington. 1). C. last Saturday morning.
Todiy is drill day for the D. S. Stanley
ex regulars. All members should at-
teud.
The Little Rosebud Social club gave a
very pleasant dance at Schwartz's hall
Saturday night. There were quite a
number present all of whom had a most
delightful time.
Private Sanford and Knoll two cavalry
men from Fort Sam Houston were run
in by the police for fastdriving yesterday
They were having a race down Houston
strebt. Each gave bond.
Private H. A. Rappold. E company
23rd infantry has been relieved from
special duty as clerk in the adjutant's
office has been appointed as school teacher
at the post. This is an agreeable change.
The guard which took the military con-
'victs from Fort Sam Houston to Kansas
a short time back has returned to the post
again.
Private J. W. McCarthy who recently
transferred to the 23rd infantry from the
Kith arrived at Fort Sam Houston yes-
terday.
Musician P. McKeone K troop 3rd
cavalry has been granted a three months
furlough. He left Fort Sam Hou-tm
yesterday. At its expiration he will be dis-
charged.

villes. Manager C. G. Knight has ar-
ranged a mammoth programme for the
week and announces the following at-

After the adjournment of the grand
jury proceeding tliu one first adjourned
the city organ ridiculed the suggestions
made by that jury and twilled them with
imbecility for aot finding indictu ante
against official offenders. Now the same
organ compares the indictment against
Callaghan as the "grand jury's mouse.”

grand jury for the full development of
its labors.

The attempt of Mayor Callaghan to re-
vamp an old ordinance passed in 1872
aud repealed so long ago that it has dis-
appeared from all printed volumes of the
city ordinances will only go to confirm-
ing the work of the grand jury.

A copy of the revised ordinances dated
June Ist 1884. does not contain Mr. Cal-
laghan’s fished up •ordinance but does
contain this provision in Sec. 2:
"That all ordinances in said digest of
revised ordinances shall take effect and
be in force from and after the Ist day of
May A. D. 1884 and all ordinances of a
general nature passed prior to the 14ih
day of April A. D. 1884 and in force
when the revised digest of ordinances
takes effect and which are not included
herein are hereby repealed.”
Where was Mr. Callaghan's ordinance
In 1884? If It existed ft was repealed.
But in 1888 another revision was made by
Mr. Bergstrom while Mr. Callaghan was
mavor. Sec. 2pr >vides:
"Sec. 2. That the digest of the ordi-
nances of the City of San Antonio when
published in book form shall be known
and may be cited as the revised ordi-
nances. That all ordinances in said di-
gest of ordinances shall take effect and be
in force from and after tne 31st day of
December A. D.. 1888 and all ordinances
of a general nature passed prior to the
31st dav of December. A. D 1888 and in
force when the revised digest of ordi-
nances takes effect and which are not In-
cluded herein be and the same are here-
by repealed.”
The truth Is there was no authority for
a mayor pro tern or acting mayor until
'he am -ndment of the eitv charter by the
legislature April 3rd 1889: and there is no
provision of the city charter or any ordi-
nance anthorizinz the mayor pro tern to
receive the mayor's salary except when
he becomes mayor by reason ot the death
removal or resignation of the mayor.
The people have become tired of this
idea that because a man holds an office
he is above the operation of the laws
that he must not be indicted for misappli-
cations of public funds; that because h'
can run a city council to suit himself
he can dictate to the court's and juries.
The people are tired of it.
There is no such sentiment that will
justify a pubbe official to defv the laws
defy the courts and defy public opinion.
If so then truly the people would be in a
bad box. Law’s made to protect th<
people’s money would be laughed at and
held in ridicule.

Only the poor friendless moneyless
thief and law breaker would find the road
to the penitentiary as smooth and swift
as a toboggan while the jeweled officials
could point to it as a pathway paved with
good inrentions.
