~ MAJOR DUHON'S MISSION.
Ordered to the Capital to Aid South-
western Irrigation.
When in his recent message to
Congress the president recommend-
ed appropriate legislation and in-
ternational consultation over the
storage and use of the waters of
the Rio Grande for irrigation pur-
poses he overlooked probably leg-
islation of the Fifty-first Congress
which gave him power to promote
this important undertaking. This
has sirrt’e been called to his atten-
tion by the large number of Texas
and Mexican citizens interested
and the president will probably in
a few weeks appoint a commission
upon the part of this Government
to confer with a similar commis-
sion from Mexico. Secretary Gres-
ham who was instrumental in
calling this matter to the atten-
tion of the president has taken
great interest|in it and has called
a conference of diplomats and sol-
diers to meet at his department on
the 10th of this month to discuss
the best plans for bringing about
the desired end.
Minister Romero already has
authority from the Mexican Gov-
ernment to act at this conference
and the outlook now seems that
immediately thereafter the Presi-
dent will appoint a commission to
consider the subject of the irriga-
tion of the arid lands In the valley
of the Rio Grande and the inter-
national boundary relations with
Mexico growing out of such a
scheme. Secretary Gresham has
asked Secretary Lamont to order
to Washington Major Dutton of
the regular army now stationed at
San Antonio and intimately ac-
quainted with the needs and con-
ditions of the southern boundary-
frontier. Major Dutton has been
ordered to report here on the 10th
of January. Colonel Anson G.
Mills of the army who is now
serving as a boundary commission-
er in boundary negotitations be-
tween this country and Mexico
will also be here on that date the
boundary commission having taken
a recess for the winter and has
been asked to attend the confer-
ence.
The citizens of the northern
boundary country near El Paso
and below are represented here by
Mr. Juan S. Hart of El Paso who
was in consultation with the Pres-
ident yesterday upon the subject.
The situation in brief is that the
uncertainty of the water supply in
the Rio Grande added to recent
large drafts upon its waters along
its upper course for mining and
irrigation purposes has caused se-
rious droughts along the Texas-
Mexican boundary where in for-
mer years there used to bo a dry
river bed only once in three or
four years but now it is an annual
occurrence of from two to four
months in duration. And flow-
ing as it does through an arid re-
gion this deprivation of water not
only for irrigation but for actual
necessity has caused a situation
serious enough to demand imme-
diate international consideration.
It is proposed not only to make
some effort to restrict the whole-
sale use of the upper Rio Grande
water for mining but also to de-
vise some scheme by which the
flood waters may be stored for irri-
gation and ordinary use during the
summer. There have been various
enterprises begun both on the
Texas and Mexican sides for the
erection of large reservoir dame in
which the great quantity of waste
flood water for which the Rio
Grande ie noted might be saved.
But nothing of this kind can be
done without international agree-
ment. Congress thoroughly con-
sidered the question in 1880 and
passed a bill presented by Repre-
sentative Lanham of Texas em-
powering the President to take de-
sired action along this line. It is
u nder this the President will prob-
ably act and that the commission
will probably be appointed.

ANTI-SCALPER LAW
D eclared Unconstiutional By a Dal-
las County Judge.

Yesterday Hon. T. F. Nash
county judge of Dallas county
gave the following opinion on the
anti-scalper law in which he de-
clared that law unconstitution all
and discharged the defendant:
No. 16574. —The state of Texas
vs. J. H. Traxler. The defendant
is charged with violating the act
of the twenty-third legislature
known as the anti-scalpers law
which prescribes a penalty of not
exceeding $5OO for selling an un-
used railway passenger ticket or
the unused part of such ticket by
any person not having a certificate
from a railway com pan y authoriz-
ing such person to make such sale.
The defendant moves to quash
the information on two grounds;
first that there is no allegation
that defendant was an agent of the
Texas and Pacific Railway com-
pany; second that the act of the
legislature under which the infor-
mation was drawn is unconstitu-
tional null and void.
We are of the opinion the act in
question clearly intends to pro-
hibit all persons from selling such
tickets except agents to whom
railway companies have given
certificates of authority and there-
fore the first ground of the motion
to 'quash is not well taken.
The second ground of the motion
appears to be well taken. The act
named authorizes a railway com-
pany to give a written permit to
any person such company may
select to sell unused tickets or un-
used tickets or unused parts of
of tickets whether such person be
anagent for the company for other
purposes or not and it forbids all
other persons Including the orig-
nal purchaser of the ticket sell-
ing the same for any consideration
whatever. If the act only restrict-
ed the sale of unused tickets to the
regular tickets to the regular
ticket agents of the company
which sells the ticket in the first
instance it would undoubtedly in-
volve a large concession of power
to the railway companies but
when it permits the company to
issue its certificate of authority to
sell unused tickets and unused
parts of tickets to any poison said
company may select and to refuse
to issue certificates to any person
said company may wish tq refuse
thereby enabling the railway com-
pany to constitute “scalpers” here
and there and prosecute as crim-
inals all other loss favored persons
who may wish to buy and sell
such tickets it is certainly a
species of descrimination and class
legislation in restraint of trade
that is inimical to our constitu-
tion. When a person buys a ticket
and pays for it the price asked it
is his property and the legislature
can not prevent him from selling
or otherwise disposing of it unless
his doing so would be a public
injury. Laws in restraint of trade
are always based upon some
public mischiefinjury or nuisance
but in thia case it is nowhere pre-
tended that the public suffers any
inconvenience whatever from the
second-hand sale of railway tick-
ets. On the contrary we may
presume the public is benefited
by it. If the railway company
has gotten the price of the ticket
can it be said that it is injured un-
less by reason of the fact that it
may not sell as many tickets as it
would sell under the operation of
this act? This however is only an
incident of the transaction and
certainly does not justify confer-
ring a monopoly upon the railway
company in selling unused tickets.
When a clothier sells a suit of
clothes and the purchaser wears it
awhile and sells the unused part
to a second-hand dealer it is
quite likely the second dealer will
sell it to some man who might
otherwise buy a new suit from
the clothier and to that ex-
tent the second-hand man is inter-
fering with the business of the
clothier but it affords no just rea-
son why a man should be compelled
if he dislikes his suit to take it
back to the clothier and receive
from him what it is worth or be
punished with thefecond-hand man
if they sell the suit to another
party. Such a law would certainly
be a restraint upon the trade that
no free government would tolerate
and there is no better reason for
the anti-scalpers act unless it can
be shown it is necessary in order
to prevent some injury or abate
some nuisance to the public. The
act is believed to be unconstitu-
tional null and void and the de-
fendant is therefore discharged
from custody.
