To the Sheriff or any Constable
of Stonewall County—Greeting:
You are hereby commanded to
summon E. R. Cosby by making
publication of this Citation once
in each week for four consecutive
weeks previous to the return day
hereof, in some newspaper in
your County, if there be a news-
paper published therein, but if
not, then in any newspaper pub-
lished in the 39th Judicial Dis-
trict; to appear at the next regu-
lar term of the District Court of
Stonewall County, Texas to be
held at the Court House thereof,
in Aspermont Texas on the 3rd
Monday in October A. D. 1912
the same being the 21st day of
October A. D. 1912, then and
there to answer a petition filed in
said court on the 23rd day of
March A. D. 1912, in a suit num-
bered on the docket of said Court
No. 975 wherein L. M. Tynes of
Gloster, State of Mississippi is
Plaintiff and E. R. Cosby and R.
C. Royston are Defendants and-
the cause of action being alleged
as follows: suit for the collection
of a certain vendors lein note for
the sum of $400.00, dated Aug.
26th 1910, payable to L. M.
Tynes 12|months after date with
interest from date at 8 per cent
per annum with 10 per cent at-
torneys fees additional in case of
collection by suit, said note al-
leged to have been executed by
the defendant E. R. Cosby in
part payment for the following
lands in Stonewall County Texas
being Sec. 42, Block G, surveyed
by-Jo D. Harrison and contain-
ing 536 acres of land. Plaintiff
alleges that by deed dated Aug.
26th 1910 he conveyed the said
land to the defendant Cosby, and
the above mentioned note is part
of the consideration of said con-
tract, and that the lein was re-
served in said deed to secure pay-
ment of said note. Plaintiff al-
leges further that the defendant
E. R. Cosbv by his deed in writ-
ing, conveyed the said land to the
defendant R. C. Royston, and as
a part of the consideration there-
of, the said Royston among other
things assumed the payment of
the said note so executed by tRe
said Cosby, and payable to the
plaintiff herein.
Plaintiff has demanded pay-
ment of said note, with all charg-
es thereon but the defendants
each have failed and refused to
pay the same or any part thereof
to the damage of this plaintiff
$525.00.
Plaintiff alleges that he has
placed said note in the hands of
T. E. Knight an attorney of As-
permont, Texas, and instructed
him to file suit thereon, for the
collection thereof, and has agreed
to pay him the 10 per cent attor-
neys fees mentioned in said note.
Plaintiff prays for citation for
the defendants, requiring them
to appear and answer this peti-
tion, and that on final trial, he
have judgment for his debt, in-
terest, attorneys fees, for costs of
suit, for foreclosure of his lien on
said land, order of sale, writ of
possession, and for general re-
lief, etc.
Herein Fail Not, But haye you
before said Court, on said first
day of the next term thereof,
this Writ, with your return
thereon, showing how you have
executed the same.

persons indébted to said estate to
present them to him at his resi-
dence, Peacock, Stonewall Coun-
ty, Texas, where he receives his

Stonewall County, Texas, to be hela
at the Court House thereof, in Asper-
mont on the 3rd Monday in October
A. D. 1912 the same being the 21st day
of October A. D. 1912, then and there
to answer a petition filed in said
Court on the 26th day of February A.
D. 1912, in a suit numbered on the
docket of said Court, No. 971, wherein
Vallie B. Reese is Plaintiff and Lu-
ther Reese is Defendant and the cause
of action being alleged as follows:
Plaintiff sues the defehdant Luther
Reese for divorce, alleging that about
the 22nd day of November 1910, she
was lawfully married to the defend-
ant in Stonewall County, Texas, and
that they lived together as husband
and wife, until about February 10th,
1911, theretofore the defendant being
guilty of harsh and cruel treatment'
towards this plaintiff and that she was
forced to abandon this defendant at
about the date last mentioned. Plain-
tiff alleges that their living together
had become insupportable, wherefore
plaintiff prays that citation issue to
the defendant in terms of the law,
and that on final trial hereof, she
have judgment of the Court dissolv-
ing the marriage relations, for costs
and general relief.
Herein Fail Not, But have you be-
fore said coiirt, on said first day of
the next term thereof, this writ, with
your return thereon, showing how
you have executed the same.
