was arrested for passing a bad cheque
on Rogers Peet & Co. of New York
and put In the Tombs. His young
wife visited him and when she pro-
tested that he was innocent In the
most convincing fashion the detec-
tives thought that she was his dupe
and never suspected that she was tho
real culprit. Tiere has long existed a
great rivalry between the precinct
detectives and the nv-n from the cen-
tral office nnd consequcn lv the cen-
tral office men wire rather sore th it
they bad been scooped on the case.
One of them on the chance of learn-
ing something about Parker presented
himself to Miss Parker as an old "pai"
of her husband's and was readily re-
ceived as such. Completely “taken in. '
she concealed nothing and even went
so far as to confess that she commit
ted the forgeries and proceeded to giv •
the detective some examples of her
free hand forgeries which he promptly
seized as evidence. Mr. Train goes on
to tell in detail of her remarkable
' methods of stealing thousands of do!-
' I ns by free-hand forgery and final! v
her audacious defense in court. It is
a story well worth reading.

manifest everywhere In the United
States. A few- features are singled
out for special mention. It is raining
in the Middle Atlantic states thence
southwestward to ea-t Texas: sleeting
in Oklahoma and snowing in New
York lipper lake region middle west
and plateau states. Over the eastern
slope It is 10 degrees to 30 degrees
colder than it was Tuesday. It is 16
degrees below freezing in northwest
Texas and 22 degrees below zero in
North Dakota. In this vicinity quick
changes are exiocted: hence the fore-
cast: Fair tonight; much colder.

Sixteen boys who made application
at the recruiting station to join the
navy this morning passed the medical
examination. Five however will
have to produce a certificate showing
the consent of the parents before they
will be accepted.
Although here but two days the offi-
cials in charge of the recruiting sta-
tion are highly gratified at the show-
ing already made and arc confident
that many recruits will be landed here.
There has been some delay owing to
then navoidabie absence of the medi-
cal director in reaching the city. Work
m>w will be pushed until the station
departs.

Opinion Handed Down by Judge Fly
In the Case of Johnson vs. Rankin
From Pecos County In Regard to
the Transfer of Cases From the
State to the Federal Court—Other
Opinions Handed Down.
The Fourth court of civil appeals
this morning rendered a decision
which will probably stand as a prece-
dent for the removal of cases from the
state to the federal courts. The opin-
ion was handed down In the Suit of
Howell Johnson et al vs. George C.
Rankin receiver from Pecos county.
This was a suit in which Rankin as re-
ceiver of the First National bank of
Newport. Ky.. filed suit against Howell
Johnson of Pecos county. Texas and
others to recover 1280 acres of land
in Pecos county. When the case was
called for trial the defendant Howell
Johnson asked that the case be trans-
ferred from his home county and the
state court to the federal court on the
ground that the plaintiff. Rankin be-
ing a receiver of a national bank was
an officer of the federal government.
The application for removal was <ir-
nied by the trial court. Judgment hav-
ing gone against the defendant Howell
Johnson and others they appealed.
In the opinion by Judge Fly this
morning the court of civil appeals
says: "There are several decisions of
federal courts that hold that a receiver
of a national bank appointed by the
comptroller of the currency. Is charged
by the laws with the execution of
certain duties. In the performance of
which he acts as nn agent and officer
of the United States and consequently
presents > case that can be removed
to a federal court under the provisions
of section 62# compiled statutes of
1901. There can be no doubt that If
llm suit had been brought against the
receiver instead of bv him. that he
could have removed the case to the
federal court but no case has been
found in which the exact question In
this case arose. Here the receiver has
instituted the suit and the defendants
are seeking to remove t’’c cause to the
federal court."
After discussing the principles of the
jurisdictional ’aw Involved the court.
In the opinion holds that the receiver
could be required to by this case In
the federal court and therefore re-
verses the case and remands It to the
district court to be proceeded with In
compliance with this decision.

A suit with a rather novel style was
placed on the docket this morning by
Clerk Hildebrand. The suit Is front

Brook vs. Glvc-a-Dam-Joncs. The case
was originally tried In the county con rt
of El Paso in which Give.a-Dam Jones
as plaintiff got judgment against
Brooks for (348.75. for commission on
a carpenter's contract. Brooks appeals
the case and therefore introduces Give
a-Dam to the honorable court of civil
appeals.

A verdict has been rendered in favor
of the plaintiff in the libel suit brought
against the Indies’ Home Journal
(published by the Curtis Publishing
Co.) by the World's Dispensary Medi
cal association of which Dr. R. V.
Pierce Is president. The suit was
brought by Doctor Pierce against the
Curtis Publishing Co. for making false
statements about one of bis standard
family medicines known as Dr. Pierce's
Favorite Prescription. In the May
number of the Ladles' Home Journal

stated that Dr. Price's Favorite Pre-
scription contained alcohol ann some
other harmful ingredients and Dr. |

this article containing such false aful
