AN ORDINANCE. An ordinance
amending section 3 and 4 of an ordi-
nance requiring the registration of
persons engaged in selling milk in the
city of San Antonio and providing for
the tests of milk offered for sale in the
said city and providing a penalty for
a violation of this ordinance. Passed
and approved September 24th 1906.
Be it ordained by the city council of
the city of San Antonio.
That section 3 and 4 of an ordinance
requiring the registration of persons
engaged in selling milk in the city of
San Antonio and providing for the
tests of milk offered for sale in said
city and a penalty for a violation of
this ordinance passed and approve 1.
September 24th 1906. be so amended
as to hereafter read as follows to-wit:
Section 3. That any person or as-
sociation of persons firm or firms cor-
poration or corporations selling or of-
fering milk for sale within the corpo-
rate Hmits of the city of San Antonio
from a cart wagon or other vehicle
or on foot or at his or their place of
business without first having register-
ed and secured the number or num
bers for each and every veh'cle used
for such purpose and posted same
upon each and every vehicle used for
such purpose and paid the fee and
complied in all things with the provis-
ions of section 1 of said ordinance
shall upon conviction in the corpora-
tion court of said cltv be fined in any
sum not Jess than $5.00 and not more
than $200.00.
Section 4. It is hereby declared to
be the duty of the citv physician to
make or have made frequent Inspec-
tions of milk offeree* for sale in San
Antonio procuring samples not ex-
ceeding one pint in measure from’ve-
hicles carts wagons dairies er from
footmen at unexpected and uncertain
hours; all samples taken shall be
plainly labeled with the number of
ihe dairy name of the driver number
of the vehicle date and time sample
was taken; and with the assistance of
the city bacteriologist if there be one
for said city the said citv phy-
sician shall carefully analyze and
test such samples and make re-
port to the board of health
of said analysis and tests such reports
to be kept on file in a book to be kept
for that purpose il shall also be his
duty to test and analyze any sample
of milk submitted to him bv anv citi-
zen of said city and make report
thereon to such persons but the re-
sults of such tests shall not be includ-
ed 1n his report to the board of health.
Every person sellinr or offering or
exnosing for sale milk shall be re-
anlred to serve or supply anv agent of
the said rltv of San Antonio or the
city nhysiclan. who shall apply to him
for that purpose and on tendering the
value of the same with a sample not
exceeding one pint as provided In this
section and any person who shall re-
fuse or fail to do any of the things
herein provided for shall be punished
bv fine not less than $5.00 or more
than *200.00.
