suit against Sheriff John W. Tobin and
hla bondsmen John A. Fraser. Sam C.
Bell and J. M. Vance for $10000 dam-
ages for alleged false Imprisonment.
Plaintiff In his petition filed In the
Seventy-third district court yesterday
afternoon late asserts that the rats In I
the county jail "make life unbearable I
by their familiarity with the person of I
a sleeping man.”
Fisher Was Arrested.
Following the outline of his recital
of injuries the petition says that Fish-
er was arrested by deputy sheriffs on
October 27 1911 at the Navasota
hotel 118 Main plaza and was
charged with being in a disorderly
house. Plaintiff indignantly repu-
diates the suggestion asserting with
vigor that he was but a transient In
the city.
Nevertheless according to the peti-
tion. plaintiff was taken to ’he county
jail and there incarcerated from 10:30
p. m. of October 27 until 6 p. m. of
October 28. at which time he was re-
leased on bond. Subsequently plain-

was dismissed by County Judge Phil

Slept on Stone Floor.
Another grievance voiced by peti-
tioner Is the alleged fact that he was
forced to sleep on the stone floor of
the county jail with but one blanket
as cover. It was while thus unpro-
tected that the rodents in numbers are I
said to have used plaintiff’s person as I
"a speedway" coursing here and there I
with absolutely no regard for the feel-1
Ings of the slumber-seeking man.
Plaintiff also lays stress on the lan-
guage which he asserts was directed
at him by other prisoners saying that
they "heaped vile epithets on him.”
He sues for $4000 actual and $0000
exemplary damages alleging that in
his chosen profession that of the
amusement business he was making
on an average of $10 per day until
forced to remain in the city hy the ille-
gal arrest and Imprisonment.

A report has been received from
Swatow that the steamer Kum Chow
of Hong Kong flying the British flag
entered the port there conveying 2000
revolutionary Chinese soldiers bound
for the north. When they attempted
to land the local troops protested and
threatened to open fire on them with
the guns of the fort. The Chinese cus-
toms commissioner and the British
consul hurriedly went on board and
saw the captain of the Kum Chow
whom they instructed not to enter the
port with the vessel.
There is great excitement over the
incident and the opinion prevails that
trouble In the southern provinces is
only beginning.
