Jurors find Miller innocent of rape

Regional Editor
Benny Ray Miller who previously was
convicted of attempted rape in Florida was
freed by a Denton county jury late Wed-
nesday who ruled him not guilty on three
counts of rape two ot there aggravated rape
Miller previously was convicted in Florida
in 1972 of breaking and entering with intent to
commit rape and assault with intent to
commit rape felony offenses for which he
was sentences to five years in the state
prison
The defendant was on trial here for an
alleged July 22 attack on Christina Juarez, in
which the victim said he hit her threatened
her life and the life of her four children if she
went to the police and raped her three times
repeatedly called Mrs Juarez story in
credible” in nix closing argument and told
the jury the victim had been picked up at a
bar drank beer with her accused attacker
and accompanied him willingly to the lake
I don 1 think if reasonable that the man is
going to rape that woman and that he
thinks rape is necessary,” Eames said
Chief felony prosecutor Fred Marsh made a
strong attack against those arguments

-AUSTIN------The Texas Court st Criminal Appeals has
stalled action on an appeal by Jackie Clinton Barber of a
Denton County .conviction and a seven-year sentence tor
aggravated assault
Notice of appeal of the case was given in January of 1975 1
and a hearing on the indigency of Barber was held in March
1975 -‘
At the hearing it was revealed that Barber had hired his
own counsel for the trial but could not pay him to make the
uppeal Barber also testified that among other debts he owed
his lawver *1 700 for the trial
The court found that the combined salaries of Barber and
his wife were not sufficient to sustain the family and that
Barber was indigent
Because of this, the appeals court found that The appeal
must be abated so that the transcription of the court repor
ter s notes may be made available to appellant as an indigent
and council may be appointed for the appeal unless further
facts are developed to show that he is not indigent
Barber was convicted in November 1974 in 211th Dist
Court of aggravated assault for the June 23. 1974 shooting
.death of Jimmy Lee McBride
The motion for a new trial based on allegations of jury
misconduct was denied by Dist Judge Sam Houston in
January 1975. Barber s attorney Mike Whitten then
presented evidence for a bill of exception to be forwarded to o
the Court of Criminal Appeals

motels Wednesday according to police reports
One motel accepted a $200 money order police said,

Alarm's a mistake
Police responded to an armed robbery in progress
alarm at the University State Bank at about 12:25 pm
Wednesday but were notified the alarm was a mistake
before units in route to the scene arrived, according to Lt
Walter G Keen
Keen said two patrol cars and a detective were dispatched
to the bank after an alarm at the police station went on, but
bank officials called the department almost immediately to
report the alarm was a mistake
Units continued to the scene Keen said, which is standard
procedure just in case someone is standing there with a gun
to his head making him make that call

Two persons were mured in a one-car accident on Sam
Bass Boulevard at Londonderry al 1:10 a m Thursday when
the vehicle apparently went out ot control on the rain-slick
street and crashed into a utility police, according to police
reports

sustained minor injuries, police said, and a passenger in the
car Patricia B Freeman, 19, of Corpus Christi, was reported
with more serious injuries ,

Peace Justice Lon Darley has ruled the death of Michael
Eugene Joins accidential and the death of Carl Dor
McLaughlin as suicide after receiving autopsy reports on the
two deaths. . .
Darley said a report filed by Dr Shan-Shan Huahg.
pathologist, concluded the cause of Joins' death was ' con-
sistent with cardiac arrest secondary to low voltage elec
trocution.”
Joins died Sept 6 at a boat dock in Lake Dallas, according -
to sheriff's office reports on the fatality
Darley earlier had ruled suicide in the death of
McLaughlin, and he said the autopsy report filed by Dr J. A
Lynn confirmed that ruling Death was caused by an over
dose of drugs, a combination of barbituates and morphine
" according to the report.
McLaughlin and his wife were found in a local motel Sept
22, both allegedly suffering from drug overdose, but his wife
