about whether they would testify, to
discuss the situation
They then returned to the courts
building, and at approximately 12 15
pm grant juror Tom Spaiding was
ushered into the grand jury room
Spalding testified for around 15
minutes, outside the presence of Cobb
or any at his assistants, before the
present grand jurors announced they
would break tor lunch and again take
up the testimony of the former grand
jurors at 2.30 p m. *
When the present grand jurors
returned at 1.30 p.m Cobb and
Houston met with them to discuss the
appointment of a special prosecutor
Houston subsequently contacted
Caldwell a former county attorney
who arrived at the courts building
around 2:30 p m and went directly to
the grand jury room.
Houston and Caldwell met with the
grand jury for approximately 10
minutes before Cobb was again
summoned to the grand jury

Darley also denied a report that the
grand jurors baked at appearing
before the current grand jury when
they learned their testimony would be
transcribed by a court reporter
“If you heard that, it’s not true," he
said “They fully expected to nave a
court reporter. It’s unusual to have a
grand jury session without a court
reporter."
Darley reiterated that his clients
had objected to Cobb s presence
during their testimony because he is a
defendant in the federal suit
However, he said the grand jurors’
“fundamental” objection to Cobbs
presence was that he has “publicly
announced be feels no obligation to
maintain the secrecy of the grand jury
room.":
Darley was apparently referring to
statements Cobb made last week
when he released a report on county
government compiled by the grand
jurors and ordered suppressed by
158th District Judge Bob Scofield
Cobb said then that his release of
the report was not a violation of the
state grand jury secrecy statute

comment on which specific statutes
would be discussed
They also reviewed the past 10
months they have been together,
during their grand jury service and
the ensuing legal battles after that
service was abruptly ended
“This is one of the closest groups
you'll ever see,” said the Rev Herb
Sprowis, minister of the First
Christian Church ia Lewisville, “and
it was like that before all the trouble
started."
The wait lengthened, and tension
grew. The comments became
somewhat more bitter in tone at
times.
“I’ve learned there are a number of
devious ways to flout the law — by the
law," said one
They began the day at a9a.m. press
conference at which they announced
continuation of their fight in federal
court against Judge Bob Scofield's

questioned how information about
their investigation was obtained by
the media during the course of the
probe
“Now, there was one person who
does not feel ethically or morally
obligated to uphold the secrecy oath."
one grand juror said

pursue the issue to the Texas Com-
mission on Judicial Conduct.
The continued fight. Vela said, is to
maintain the "critical function" of a
grand jury as representative of the
people in investigating and reporting
on local government
"I think it is interesting that the
distinction was made that previous
grand jury reports were innocuous
Does that mean, if conditions are all
right, then it is O.K to report?” he
said
“The manual (a manual of in-
structions for grand jurors) says you
are to report on the conditions of the
county," former grand juror Deborah
■ Darley said. “As long as you say the
conditions are good, you can issue a
report," she said
Danielson quoted a letter he said
was sent to him signed only, “an
anonymous admirer " The writer
suggested that the grand jury panel
order prohibiting them from issuing a.
report on county government.
They contend the order violates
constitutional privileges. They argue
that subsequent actions nullifying the
order, such as the immunity given
them and dismissal of contempt
charges, do not remove the con-
stitutional limitation.
And they said they also plan to
must be unfamiliar with the First
Amendment requirement that "if you
don't have something nice to say, keep
your collective mouth shut,"
Danielson said
Just before 4 p.m Houston named
Bob Caldwell as special attorney and
prosecutor to replace Cobb in in-
teraction between the former and
present grand juries

was being beaten .
Officers made the arrests Thur-

surburban high school — about the
time other Holmes students were
attending the funeral for 15-year-old
Billy Barnett, a sophomore member
of the school s Rodeo Hub

JOHANNESBURG. South Africa
AP - South Africa today denied
US intelligence suggestions that it
set off a nuclear device, calling the
report total nonsense verging on
science fiction.
Dr J Wynand de Villiers, president
of South Africa’s Atomic Energy
Board, said the report indicating
South Africa might be on the brink of
joining only six other nations in the
world’s known atomic arms club was
“complete nonsense "
“I have no know ledge at all of such
“an explosion,” he said. “If there was
anything of the sort, my first reaction
would be that some other powers
might have undertaken a test, but it
was definitely not South Africa "
Foreign Minister .Roelof F Botha
declared. “I know absolutely nothing
about this matter, whatsoever
"Why don't you ask the Russians or
the Chinese, or even the Americans,"
Botha asked sarcastically “South
Africa is not Antarctica We might
even be talking about Australia or
New Zealand
“It is a particularly vast area in
which the phenomenon is supposed to
have taken place If the Americans
don’t know what is going on. I suggest
they first make sue of their facts
before they run away with the idea
“It might even have been the
rebirth of Venus. I suggest that the
Americans ask Neptune for a
report..".
Botha said the United States, “as
leaders of the Western world, should
not panic so easily...”
US. officials told reporters in
Washington Thursday night they had
evidence South Africa may have
exploded a nuclear device in the at-
mosphere last month

NT probe -—---
( Continued from Page 1
Cobbs name first surfaced in
connection with allegations of bid-
rigging in the physics department over
an equipment sw ap involving the sale
and trade-in of old machinery for new
machinery
Cobb has admitted be knew when he
compiled a list of prospective bidders
for the equipment exchange that three
of the firms had financial ties, but he
denied the bid invitations were
deliberately rigged so one firm would
get the bid
Bid invitations for six firms were
prepared and placed in the physics
department interdepartmental
mailbox. Cobb said University
records, however, show that only
three bids were later received from
the three firms with financial con-
nections.
Shaver estimates the team here’
will conclude work in two or three
weeks, but could give no prediction on
when results of the, investigation will
be made public
: Results of the work will go to Austin,
be said, and any public an-
nouncements will be made either by
Andy Shuval, executive director of the
Texas Prosecutors Council, or
through Jim Vollers, special counsel
for the legislative committee that
ordered the university investigation.
A special House Investigating
Committee initiated the probe into
university financial affrirs. and the
council later appointed represen-
tatives of district attorney offices
from Harris. Dallas. Tarrant and
Bexar Counties to conduct the in-
vestigation
The team is charged specifically
with looking 'into accusations of
diversion of funds from the university
to the university foundation, possible
illegalities in financial arrangements
for a political rally at the NTSU
Coliseum for gubernatorial candidate
John Hill and allegations of bid-
rigging in the physics department at
NTSU.
