TiietState of Texas To the Sheriff of
Austin County—Ortcting
WHEREAS, A, E. Sternenberg. a re-
sident of Austin county, In said
State, has tiled his petition in tho District
Court of caiil Austin oountv, against O. F.
Sinclair, whose residence is unknown to
petitioner, alleging that, said Sinclair on
the flrst day of January, a- u., 1801, for a
valuuble, consideration, made, executed
and delivered to petitioner his certaim
jiroinitisory note, for the sum of two hund-
red and thirty-five dollars, binding himself
and promising to puy said sum to the order
of petitioner, six months after the Sate
thereof, with interest thereon, at tho rate
of ten per cent per annum.
That previously, to wit: on the 20th
December, I860, tho said defendant, for a
valuable consideration, made, executed and
delivered to plaintitf his certain other pro-
missory note, for the svm of one hnndred
and tifty dollars, binding himself and pro-
mising to pay said sum to the orde^tf
pluintilf, eight months after the dato%f
said note, with interest thereon, at the rate
of ten per cent per annum; that said two
notes, marked "A," and "B," are attached
to said petition as a part thereof; that said
two notes are due and unpaid, to plaintiffs
damage five hundred dollars. Wherefore
he sues, and prays that said defendant be
cited to appear aud answer said petition;
that upon the hearing, ho may have judg-
ment against defeudaut for the amount of
said notes, principal and interest, nnd for
general relief. And aflidavit having been
made according to luw-¿
YOU are hereby commanded that yon
summon O. F. Sinclair, hy publication as
tho law directs, to l>o aud apocar before
the Honorable, the District Court, to be
liolden within and for the county of Austin,
at the Court-house thereof, in the town of
Bellville, on the ninth Monday after the
first Monday"ln October, a. t)., 1861, then
and there to answer the petition of A. E.
Sternenberg, a brief of which is given
above.
