In llie líame and by the authority of the State of
Texas—To the Sheriff of' said County, Greeting :
WHEREAS, Allen Caruthers, a citizen of
DeWitt county, Texas, has filed his peti-
tion in the District Court of Gonzales Coun-
ty, representing that he made, executed, and
delivered unto Volney E. Howard a certain ob-
ligation or agreement in writing, by which he
bound himself to convey 500 acres of land, to
be selected out of certain lands mentioned in
Raid agreement, being surveys No. 98, class
No. 2 lor i league, No. 96, class No. 2 for i
league and a survey of 870 acres, being an
augmentation granted said A. Caruthers, and
lying in Gonzales Land District; that said ob-
ligation or agreement, was given upon condi-
tion that lip was to convey said 500 acres of
land aforesaid, in case said V. E. Howard as
his attornoy, should succeed in defending him
against a certain suit mentioned in said agree-
ment, and establishing said Caruthers' cer-
tain locations; that he employed said Howard
to attend to said suit, being a suit instituted
by John York against him in the District
Co
Jourt of Gonzales count}', Republic of Toxas.
Pcjtjtioner represents that said Howard failed
to attend to said suit, and failed in establishing
said locations, and that on account of said fail-
ure of said Howard, as aforesaid, he lost a val-
uable portion of said land, and (said Howard
not having complied with said agreement, he
prays that said agreement be annulled and
canceled, &c. Prayer is also made for costs
of suit and for equity and general relief, and
Wm. II. Stewart as attorney of said A. Ca-
ruthers, has made affidavit before me that tho
said V. E. Howard is hot a resident of this
State.
These are therefore to command you to sum-
pion the said Yolticy E. Howard, by making
publication of this citation for four successive
■weeks in the Gonzales Inquirer, a newspaper
(published in the town of Gonzales, that he be
and appear before tho Honorable the District
Court of said State, to bo holden in and for
said county, at tho Oouct-houfeo thereof, in the
town of Gonzales, on the seventh Monday af-
ter the first Monday in March, A. D. 1854,
then and there to answer said petition.
Herein fail not, but of this process with
your service, make due return to said Court.

in the 80th year of his age, a No. 1 field hand and
wagoner. Sold for no fault whatever, but purely
for the luxury of being out of debt.
I' also offer at private salo my VALUABLE
TRACT OF LAND, situated upon the west
bank of the Guadalupe river, three miles
tho town of Gonzales, containing 1258 acres, about
270 of which are in cultivation, and upon which is
a dwelling house, kitchen, smoke house and five
negro cáblne. Also a NEW GIN AND PRESS, all
in good running order.
With the above will be sold if desired a post
oak tract adjoining the above, containing 1105
acres, one half of which is as well timbered as any
iu the country. The titles are indisp'utably good.
A^further description of the above property is
deemed useless, as no man will think of purchasing

the duties and obligations devolving on him ss Ad-
ministrator, as aforesaid, that ho wasted the Estate,
and appropriated the assets thereof, to his own use,
that large amounts of monies,'Ac., came into the
hands of said Moore as Administrator, as aforesaid,
and that said Moore has hever accounted therefor,
either to tho Probate Cdurt or Petitioner, or any
one else, that said Moore as Administrator, as afore-
said, has never pud any debt of the Estate; and
has hitherto refused and still refuses to pay over to
Petitioner the amount of money or, property of tho
Estate which came into his possession us Adminis-
trator, as aforesaid, and has embezzled, and pasted
said Estate, and acted fraudulently therein, and
that said bond has been broken and forfeited, and
that said Moore, Smith and Breches have become
liable on said bond for the damages alledged, to-wit:

against all three of said obligors in said bond and
for damages, costs of suit, equity and general relief;
and Wm. II. Stewart, Attorney for said Richard
Wells as Administrator, as aforesaid, having made
affidavit before me that the residence of the De-
fondent, E. W. Moore, is unknown to the affiant;
these are, therefore'/to command you to cite tho
said E. W. Moore by making publication of this
