S. B. No. 237, A bill to be entitled
An Act to establish the Texas Air
Control Board, prescribe its powers,
duties, functions, and procedures, and
to provide for the establishment of
standards of air quality and the con-
trol, prevention, and abatement of
air pollution; validating actions of
the Texas Air Control Board created
by Chapter 687, Acts of the 59th
Legislature, Regular Session, 1965
(Article 4477-4, Vernon's Texas Civ-
il Statutes); providing penalties; re-
pealing Chapter 687, Acts of the 59th
Legislature, Regular Session, 1965
(Article 4477-4, Vernon's Texas Civil
Statutes); and declaring an emergen-
cy.
The bill was read second time.
Mr. Burgess offered the following
committee amendment to the bill:
Committee Amendment No. 1
Amend S. B. 237 by striking all be-
low the enacting clause and substi-
tuting therefor the following:
"Section 1. This Act may be cited
as the 'Clean Air Act of Texas, 1967.'
It is the purpose of this Act to safe-
guard the air resources of the state
from pollution by controlling or abat-
ing air pollution consistent with the
protection of health, general welfare
and physical property of the people,
operation of existing industries and
the economic development of the
State."
"Sec. 2. The following terms as
used in this Act shall, unless the con-
text otherwise requires, have the fol-
lowing meanings:"(A) 'Air contaminant' means par-
ticulate matter, dust, fumes, gas, mist,
smoke, vapor or odor, or any combi-
nation thereof produced by processes
other than natural.
" (B) 'Source' is any and all points
of origin of the items defined in Sec-
tion 2(A) whether privately or pub-
licly owned or operated.
"(C) 'Undesirable levels' of the
items defined in Section 2(A) here-
of is the presence in the atmosphere,
as limited by Section 4(C) hereof,
of one or more air contaminants or
combinations thereof, in such concen-
tration and of such duration as are
or may tend to be injurious to or to
adversely affect humans, animal life,
vegetation or property, or as to in-
terfere with the normal use and en-
joyment of animal life, vegetation or
property.
"(D) 'Air Pollution' means the
presence in the atmosphere of unde-
sirable levels of air contaminants.
"(E) 'Board' is the Texas Air Con-
trol Board created by this Act.
"(F) 'Person' is any individual,
partnership, copartnership, firm, com-
pany, corporation, association, joint
stock company, trust, estate, politi-
cal subdivision, or any other legal en-
tity of their legal representatives,
agents or assigns."
"Sec. 3. (A) There is hereby creat-
ed and established a Texas Air Con-
trol Board which shall be composed
of nine members. The board is direct-
ed to carry out the functions and du-
ties conferred on it by this Act. The
six members of the Texas Air Control
Board appointed by the Governor un-
der the provisions of Section 3(A),
Chapter 687, Acts of the 59th Legis-
lature, Regular Session, 1965 (Ar-
ticle 4477-4, Vernon's Texas Civil
Statutes), upon their confirmation by
the Senate, are hereby constituted
members of the board created by this
Act. These members shall continue to
serve until the expiration of their
appointive terms, and until a success-
or has been appointed and has quali-
fied. As the terms of office of the
members appointed under the pro-
visions of Section 3(A), Chapter 687,
Acts of the 59th Legislature, Regular
Session, 1965 (Article 4477-4, Vern-
on's Texas Civil Statutes), expire,
the Governor, with the advice andHOUSE JOURNAL
