in the 39th Judicial District, but If
there be no newspaper published in
said Judicial District, then in a news-
paper published in the nearest Dis-

plaintiff owned all of the above .-In-
scribed tracts of land by virtue of the
five and ten years statute of limlta
tion of Texas; that for more than
five years next preceding the filing
of this suit the plaintiff was in peace-
able continuous and adverse possess-
ion of the above described lands, cul
tivating, using and enjoying the same,
and havihg the same fenced ttnd en-
closed Ohd paying taxes tharaon be-
fore they became due and delinquent
.each year, and every year, and claim-
ing the same under a deed duly re-
gistered in the County Clerk's office
of Stonewidl County, Texas, and by
reason thereof has title to said lands
by reason of the five years statute
of the state of Texas, which he spec-
ially pleads; and further, the plain-
tiff shows to the court that he ha.i
had peaceable, continuous, and ad-
verse possession of the above describ-
ed lands, cultivating, using, and en-
joying the same, and having the same
duly enclosed by fence, for more than
ten years next preceding the filing of
this suit; and by reason thereof has
title to said lands by reason of the
ten years statute of limitation of the
state of Texas, which he specially
pleads, and thereafter, on the same
day and date, the defendants unlaw-
fully entered into the possession of
said premises, and ejected plaintiff
therefrom and withholds from him
the possession thereof, to the plain-
tiff's damages in the sum of $1,000.00,
Petitioner further shows to the court
thnt the rental value of said premis-
es is $200.00 per year.
Wherefore, plaintiff brings this
suit and prays for citation as the law
directs, and that upon final liearln,"
hereof he have judgment for the ti-
tle and possession of said property
and premises, and for writ of resti-
tution, and for such other and further
relief, both general and special, as in
law and in equity he may be entitled
to.
Herein Fail Not, but have before
said Court, at its aforesaid next reg-
ular term, this writ with your return
thereon, showing how you have exe-
cuted the same.
