Twice Sustained and Twice De-
clared Unconstitutional,

here Monday that tic I nited States
Supreme Court had refused a rehearing

the law of the Twenty-ninth legisla-
ture laying a tax of 1 per cent on the
gross earning:, of Texas railroads. The
state loses approximately $400,000
taxes, which were due under said luw,
but will novei receive it, as this de-
cision i. final. Tho author of tho lu>v
is T. IS. Jvove, the present superin-
tendent ol banking anil insurance.
Quite a few railroads, particularly tho
smaller lim paid the tax. but the
court now :-ays the> did not have io,
that it wa unconstitutional. A divide t
court effected the decision, five judges

was a most important principle, and j
the Texas case will be quiet for years
to come. The trial court here sus-

legal resource of counsel was exhaust-

would turn his prisoner over to the

in Justice J. D. Moore's court Wed-
nesday for Charles D. Morris, one of
the trustees of the Fiskvllle school
district, north of An tin, on the charge
of "unlawfully preventing the use of
a certain text-book In a public school "
The warrant was placed in the hands
