Tlie case of Mrs. Stella Thomason
against the M, K. \ T. R. R. Co. tried
in the District Court of this county in
which Mrs. Thomason recovered judg-
ment for damages for the death of her
husband, has been reversed by the
Court of Civil Appeals at Austin and
thi Railroad Company granted new
tri:.l. This ease has been tried twice
in the District Court. On the firs?
trial the Court set aside the verdict
and granted a new trial. The case
wa> then carried to the Court of Civil
appeals and the Supreme Court, the
judgment of the Court below being
upheld.
Another trial was had in the Dis-
trict Court and a judgment rendered
for Mrs. Thomason. From this judg-
ment the Company appealed assigning
as error the misconduct of tL< jury
and many other errors. The appeal
has now been sustained and the case
reversed for a new trial.
