son, and it is also expressly understood that all the pay- ments above stated made in advance by said Smith are to be forfeited forever and neither he said Smith, nor any of said families for whom he contracts shall ever at any time have any claim whatever on said Austin or any other person for said sums so advanced. It is also understood that said Austin shall not be in any way responsible for any difficulties or embarrassments which may arise in delivering the titles to each of said families as before stated, in consequence of any revolution or change aar this govt, or any other circumstance which may be beyond the contrdl of said Austin, or in consequence of any laws, or- ders, grants or decrees of this govt, which are beyond the Control of said Austin.
