The Texas Department of Health adopts on
an emergency basis an amendment to
37.93, concerning payment of services. The
amendment enables the Chronically III and
Disabled Children Program to reimburse pro-
viders for services rendered but not paid
when all requirements were met except the
filing deadline. The amendment also allows
the Commissioner of Health to waive the fil-
ing deadlines upon his determination that
good cause and exceptional circumstances
have been shown.
The amendment is adopted on an emergency
basis to enable the Commissioner of Health
to waive filing deadlines as soon as possible
for certain providers so that they can be paid
immediately. The situation has arisen
whereby certain providers, unless they can
be reimbursed by the department immedi-
ately for services provided, will no longer be
able to participate in the program. The loss of
these providers would prevent the prompt
and immediate identification, diagnosis, and
evaluation of certain chronically ill and dis-
abled children, thereby creating an imminent
threat to public health and safety.
The amendment is also being proposed for
permanent adoption in this issue of the Texas
Register.
The amendment is adopted on an emergency
basis under Texas Civil Statutes, Article
4419c, 8, which provide the Texas Board of
Health with the authority to adopt rules con-
cerning the Chronically III and Disabled Chil-
dren's Services Program; Texas Civil
Statutes, Article 6252-13a, 5, which provide
the department with the authority to adopt
rules on an emergency basis; and Texas Civil
Statutes, Article 4414b, 1.05, which provide
the Texas Board of Health with the authority
to adopt rules for the performance of every
duty imposed by law on the Texas Board of
Health, the Texas Department of Health, and
the Commissioner of Health.
37.93. Payment of Services. Payment for
any service authorized by the program may
be made only after the delivery of the ser-
vice. The family must not be billed for the
service or be required to make a pre-admission or pre-treatment payment or de-
posit. Providers and facilities must agree to
accept established fees as payment in full
although such fees may be below usual and
customary charges.
(1) Claims, payment, denial, and
rejection. All payments made in behalf of a
patient will be for claims received by the
program within 90 days of the date of ser-
vice, 90 days from the date of discharge for
inpatient hospital claims, or 90 days from
the date of standard authorization, if autho-
rized, and/or within the submission dead-
lines listed in subparagraphs (B)-(C) of this
paragraph, or as stated in paragraph (6) of
this section. Claims will either be paid,
denied, or rejected, generally within 30
days. The only exception Is that the com-
missioner may waive the filing deadlines
upon his determination that good cause
and exceptional circumstances have been
shown.

The Comptroller of Public Accounts adopts
on an emergency basis the repeal of 3.141,
concerning occupation tax on attorneys-
reports and due dates. The section is being
repealed in order that a substantially revised
section dealing with the same subject matter
may be adopted.
The section is being repealed on an emer-
gency basis in order to allow for a new sec-
tion which provides guidance to affected
attorneys before the due date arrives. The
due date for this tax is August 1, 1988.
The repeal of this section is adopted on an
emergency basis under the Tax Code,
111.002, which provides the comptroller with
the authority to prescribe, adopt, and enforce
rules relating to the administration and en-
forcement of the provisions of the Tax Code,
Title 2.
