Canadian wins recycling award
The Panhandle Regional Planning Commission awarded Canadian the best recycler award on
Monday. The award is given by PRPC each year on Texas Recycles Day, which was Monday. The
awards honor the communities that recycle and compost the most materials that would otherwise
end up in a landfill. Canadian won the recycling award, diverting 270 pounds of waste per resident
through its recycling program last year. Stratford, Panhandle, Dumas and Dalhart also received
recognition. Stratford received the best composters award, diverting 779 pounds of wood and
yard waste per person through a composting program. #47

Canadian resident convicted of
possession of amphetamine
John Buschman was convicted of posses-
sion of a controlled substance more than one
gram but less than four grams in the 31st
District: Court Monday. Buschman was pulled
over for a traffic violation November s, 2003, by
Hemphill County Sheriff's Deputy Shawn Wa-
ters during which amphetamines were found.
Assistant District Attorney Lynn Switzer
laid out the events of the night in her opening
statement to the jury, illustrating how on the
night of November 5, 2003, Sjefka, the drug
dog, got a hit on the inside of the vehicle during
a search and that substance was later identi-
fied as amphetamines. "Everything you heard
the DA tell you is her opinion," defense attor-
ney Jeff Jones rebutted. "It's :not evidence."
The jury heard from Deputies Waters and
Dave Thomas, and saw the video recording
from the stop and arrest.
Waters testified that on November 5,2003,
he was running a stationary traffic, patrol at
Second and Purcell streets when a four-door
white Cadillac rolled through a stop sign. Wa-
ters said he began following the vehicle, which
then accelerated. The vehicle turned onto El-
liot Street and came to a stop at the railroad
crossing. Waters stopped and approached the
vehicle.
Once Waters discovered it was Buschman,
he ran a history check and confirmed that
Buschman had a prior criminal record involv-
ing drugs, at which point he contacted Deputy
Thomas to bring the drug dog for a search.
Waters said he informed the defendant he
had run a histoiy check and knew Buschman
had been involved with drugs. Buschman ini-
tially declined a voluntary search after being
asked if he had any drugs in the vehicle. Bus-
chman said the car belonged to his father, but
that he had nothing to hide.
Deputy Thomas testified that the dog began
a, search on the outside of the vehicle and got a
hit. Sjefka then jumped inside the vehicle.
"It was definitely an unusual response,"
Thomas said. "That was the first time I'd had
him jump into a vehicle like that."
A green container was then found in be-
tween the front seats. It contained a bag of
white powdery substance and some parapher-
nalia. Waters did a field test for methamphet-
amine, but it came out negative. Another field
test for amphetamine was done at the Sheriffs
Office, and it tested positive.
Photographs were taken at the scene, and
Waters wrote a sworn affidavit saying Bus-
chman was in possession of more than four
grams, but less than 400 grams of amphet-
amine, Jones pointed out in cross examination.
Jones argued Waters was wrong in charging
Buschman with possession of more than four
grams of amphetamine without specifying that
the substance and the container in which it was
found were both factors in the weight.
The jury deliberated for less than 30 min-
utes before returning a guilty verdict. Bus-
chman was sentenced to six years probation
and ordered to pay a $2,000 fine.
