turned home from Missouri, where
she has been serving as home demon-
stration agent.

dents of Shreiner Institute, Kerr-
ville, were week-end guests in the
home of Mr. and Mrs. Alex Waugh.
Mrs. J. S. Holme had • week-era
visitors Mr. and Mrs. J. D. Goodgamc
and daughter, Bobby, of 'Stephonville.
Mrs. Ronnie Hicks and children leit
last week for Mansfield, Louisiana,
where she will make her home tem-
porarily, until Mr. Hicks can arrange
for living quarters for them in Bas-
trop. Mr. Hicks is manager of the
Western Auto Associate Store here,
and the couple have made their home
here for the past several years.
Mrs. Jack Wr ight and Betty
Wright acompai.ied Louis Wright to
Dallas last week, where lie was one
of three out of .'30 to pass a naval ait
examination. He will leave for Grand
Prairie the latter part of this month
to begin his preliminary training.
The three of them wont from Dal-
las to Wills Point to visit relatives
before returning home.
Mayor Will Rogers, City Attorney
Bower Crider and J. E. Haines, mali-
nger of the City Electrical Depart-
ment, were business visitors in Fort
Worth Sunday and Monday.
Miss Mary Pearl Erhard of the
University of Texas spent part of
midterm holidays in Corpus Christi
and the remainder with her parents.

Mrs. A. R. Henry of Breckenridge
and Leroy Koenig. a machinist in
Duncan Field in San Antonio, spent
the week-end in the home of Mrs. R.
J. Griesenbeck, They were joined

nig, Miss Beitha Nell Koenig and
Miss Evelyn Koenig at Bryan and Mr.

An Ordinance Regulating the Oper-
ation of Coin-Operated or Nickele-
dians in the City of Bastrop; l're->-
crihing License Fees For Such Oper-
ation: Prescribing Penalties For Vio-
lation and Declaring an Emergency.
BE IT CRDAIiNiFD BY THE CITY
COUNCIL OF THE CITY OV
BASTROP:
SECTION' 1. This entire ordin-
ance .-hall be deemed in exercise >i'
the police power "f the City for the
protection of the welfare, health,
peace and tempeiance <f the peoph>
of the City, and all its provisions
.>hall be liberally construed for the
accomplishments of that purpose.
SECTION 'J. It shall be unlawful
for any person as hereafter de-
fined, either as principal or an agent
or representative of another, to en.
gage in the busings of operating
coin-operated phonographs or nick-
elodians within the corporate limits
of the City of Bastrop without first
having obtained a Mccnse therefor
from the City of Bastrop and <1 is
playing such license as hereinafter
provided.
SECTION 3. (a) The word
"person" when used in this ordinance
shall for the purposes of this Ordin-
ance, mean every natural person,
firm, co-partnership, association par-
tnership or corporation owning any
coin-operated phonographs or nick-
elodians; and the term person shall
include both singular and plural; the
masculine shall embrace the femin
ine gender,.
(b) The term "com-operar.
ed phonographs or nicki Indians" as
used herein shall mean and include
every coin operated machine of any
kind or character', which dispenses
or vends music which is operated by
or with coins, metal slugs, tokens or
checks.
SECTION 4. Every person, before
beginning the business of operating
coin-operated phonographs or nick-
elodians shall apply to the City Tax
Collector and Assessor for a license
to operate such business upon a
blank to be furnished by the City
Tax Collector and Assesror, on .i
form prescribed by such office.-,
which application shall include th
full name of the applicant; his home
address and business address, includ-
ing the street and number; whether
applicant is an individual, partner-
ship or corporation and the names
end addresses of the partners or dir-
ectors of the corporation; the name
under which place of business; th«-
length of residence in the State and
County; whether applicant has been
convicted of a felony and such other
information as the Tax Collector and
Assessor may prescribe. Every such
application for license shall be sworn
to by the applicant.
SECTION 5. No license shall bo
transferable or assignable but -hall
be valid only for the use of the lic-
ensee named therein. Should a lic-
ensee desire to change his place o!
business to another location, he shall
give written notice thereof to the
Tax Collector and Assessor, who
shall attach to the license in writing
a record of the change md the date
thereof, which record shall be auth-
ority for the operation of such busi-
ness under such license at such new
location.
'SECTION 0. (Each licensee hen
under shall keep a complete set of
records showing a list ef coin-oper-
ated phonographs or nickelodians
owned, the serial number of each ma-
chine, the address of the location >>f
each such coin-operated phonograph
or nickelodian, the name of the per-
son in whose place of business same
is being operated, the type of busi-
ness, and the approximate opening
and closing hours of such place ot
business. Such records shall be sub-
ject to inspection by the Tax Collec-
tor rind Assessor of the City of Bas-
trop and his duly authorized agent*
at all reasonable times during busi-
ness hours.
SECTION 7. (a) in order to de-
fray the expense necessary to pro-
vide surveillai.ee. supervision and
inspection of such business requir-
e l under the terms of this Ordinanc«
there is hereby levied a License fe«
of $200.00 per annum fo- every per-
son engaged in such business, which
fee shall be collected by the Tux
Assessor and Collector from each nt>
nlicant for each such license. Sa; I

nrnl basis and shall be due and par-
able for any rear not later than th-1
10th day of January of such year,
such fee to cover the calendar year.
The license fee shall be paid *o the
Tax Assessor ami Collector of the
City of Bastrop after the applicant
has filed the application herein pro-
vided and secured said licensee as
herein nrovided,
(h) The first fee annual t >

SECTION1 *. The Tax Collector
may, in his desert tion refuse to is-
sue a license to any applicant an I
may tnncel. revoke, or suspend the
operation of anv license by him
granted for th< following reasons:
(a) That the applicant or lic-
ensee is unable to comply with the
provisions of the ordinance.
(b) That public convenience
and welfare does not justify the is-
suance of such license.
(c) That said applicant or
licensee is guilty of gross immorality.
(d) That said applicant or
licensee is guilty of any fraud, de-
ceit or misrepresentation in the pro-
curement of said license.
(e) That said applicant or
licensee is unfit or incompetent by
reason of negligence in operation <>l
his business.
(f) That said applicant or
licensee has been convicted of a fel-
ony o a misdemeanor.
(g) That said applicant or
Fcensee is in habitual drunkard or-
is addicted to the use of morphiit' .

(h) Any license granted un-
der this Ordinance shall be subject
to recovation by the City Council of
the City of Bastrop after due notice
to the holder <>f rich license and

SECTION 9. (;>) Any person n-

violate any provision of this Ordi-

ed.
■SECTION U. If any section, par-
agraph, subdivision, clause, phrases
or provision of this Ordinance shall
be adjudged invalid or held uncons!'-
tutional by a court of competent jur-
isdiction, the same . hall not affect the
validity of this Ordinance as a whole
r any part or provisions other than
the part so decided to be it.valid or
unconstitutional.
SECTION 12. The fact that exist-
ing Ordinances of the City of Mas
trop do not afford an adequate and
comprehensive regulation of coin-
operated phonographs and nickelod-
ians, and the further fact that there
exists an increasing necessity for
such regulations in order to protect
the welfare, health, peace and tem-
perance of the citizens of Bastrop,
create an emergency and an impera-
tive necessity, which require the sus-
pension of the rules, and it shall be-
come effective after its passage ami
publication.

NOTICE OF INTENTION TO
ISSUE REVENUE BONDS
Pursuant to the provisions of
Chapter No. lfi.'i, Acts of the 42nd.
Legislature, notice is hereby given
that the City Council of the City of
Bastrop, Texas, will on February
16th, 1942, at 7:30 P. M. pass such
ordinances to take such action as may
be deemed necessary to authorize the
issuance of "City of Bastrop Water
Works System Revenue Bonds", in
an amount not to exceed $">5,000.00,
maturing serially over a period of
not more than twenty years, with in
terest payable semi-annually at a rate-
not to exceed four per cent per an-
nuo for the purpose of securing
funds with which to build and pur-
chase a Water Works 'System in ac-
cordance with the provisions of Art.
Nos. 1111 to 111S, inclusive, Revised
Civil Statutes of 192« as amended.
According to provisions of law,
said bonds shall be payable annually
from the revenue of said System, af-
ter deduction of all necessary opera-
tive and maintenance expenses, li>
eluding reasonable depreciation and
there shall be printed on the face of
each and every bond, an interest con
pon following the Statutory provis-
ions 'the holder hereof shall never
have the right to demand payment ot
this obligation out of any funds rais-
ed or to be raised by taxation."
These bonds or interest thereon
shall he paid only from the net re-
venue of the Water Works System to
1>J built and purchased and shall not
be a debt of the City of Bastrop.

Section 1. This entire ordinance
hall be deemed an exercise of th'
police power of the City for the pro-
tection of the welfare, health, peace
and temperance of the people of the
City, and it shall be so construed.
iScction 2. It shall hereafter be
unlawful to sell or to engage in the
i.usiness of selling liquor as defined
by the Texas Liquor Control Act
within the City of Bastrop except
where the place of business is in the
following area:

HIGH GROVE, Feb. 3—Mrs. Kate
Await who ha has been seriously ill
with double pneumonia is improving.
Her s .it and his wife front West Tex-
as are visiting her.
H< sie Robinson and son were Bas-
trop visitors Friday.
The farmers are getting ready for
rain. The tanks are all about dry. and
some say it is too dry to finish break-
ing their land. Quite a few cattle
have been sold the last month in this
neighborhood.
A. B. Franks and son and Mr. Tay-
lor from Tilman were brief callers in
the home of J. S. Ferguson and Mr.
and Mrs. J. E. Sharp Sunday even-
ing.
Mrs. Ray Holder was a guest in
the Rev. Draper home Sunday. A
man from Austin hau erected several
monuments the last two months in
the High Grove cemetery.
News is scarce, will try and do
better next time.
