Hour Law Exemptions
SAN ANTONIO. Employer* in
Southwest Texas today were ad-
vised that an explanatory bulle-
tin will be available next w.sek on
the revised regulation* governing
exemption of so-called "white
collar" employees under the Wane
and Hour Law adopted in Wash-
ington today by Administrator
Win. R. McComb.
Jack (J. High, field office super-
visor of the U. S, Department of
Labor's San Antonio office of the
Wage and Hour and Public Cen-
11arts Divisions, also called at-
tention of employers to the fact
that the revised regulations will
take effect on January 26, the
day on vs'hich the Fair IjiIhh
Standards Amendments of
applying to the Wage-Hour Law
as a whole, take effect.
These revised regulations govern
the Wage-Hour Law exemptions
for workers employed in "EXE-
CUTIVE," "A I > MINISTR ATI VIE,"
"PROFESSIONAL," "LOCAL RE-
TAILING." or "OUTSIDE SALES-
MAN" capacities. I^tst substan-
tially revisod in 1940, the new
regulations contain tests of duties,
responsibilities, salary levels, and
other basis requirements which
employees may be exempt from
the Wage-Hour Law's minimum
wage and overtime pay provisions.
For three classifications of
"white collar" employees, the re-
vised regulations contain new
alary tc-t The new salary test
for "EXECUTIVE" employee will

instead of the 1940 test of $:to a

f..r "ADMINISTRATIVE" and

The new regulations include a-
mong rheir basic requirements that
(A) "EXECUTIVE" employee-
nu-t perform in an age rial duties;
(B i "A DM INLSTRATI VE" employ-
ees must perform office or non-
manual field work of substantial
importance in the management or
operation of the busines; (C)
"PROFESSIONAL" e mplu y e e s
must perform work requiring ad-
vanced knowledge in a field of
science or learning, or oerform
creative work in an artistic field;
(D) "LOCAL SALESMEN" must
be engaged to sell, away from
their employer's place of business.
Mr. High cautioned employers
not to decide an employee's ex-
emption on the salary test alone,
or on job titles. The explanatory
bulletin is intended to aid em-
ployers in avoiding errors in class-
ifying employees as exempt.
The bulletin also advises on the
use of the new provisions of the
revised regulations for determin-
ing the exemption status of em-
ployees who are paid at least
$100 a week on a salary basis.
Under these provisions, shorten-
ed tests are established for de-
termining whether such employ-
ees meet all the specific require-
ments of the "EXECUTIVE," "AD-
MINISTRATIVE," or "PROFES-
SIONAL" definitions.
