Sue Dillard, Office of Standards and Quality Assur-
ance director, has determined that for the first five-
year period the rules will be in effect there will be no
fiscal implications for state or local governments or
small businesses as a result of enforcing or administer-
ing the rules
Ms. Dillard has also determined that for each year of
the first five years the rules are in effect the public
benefit will be the improvement in quality of care af-
forded clients of TDMHMR facilities and community
centers. There is no anticipated economic cost to in-
dividuals who are required to comply with the rules
as proposed
Comments on the proposal may be submitted to Lin-

lication
The new sections are proposed under Texas Civil Stat-
utes, Article 5547-202, 2 11(b), which provide the
commissioner with the authority to promulgate rules
of the department subject to the basic and general
policies formulated by the Texas Board of Mental
Health and Mental Retardation
405.731. Purpose. The purpose of this subchapter is
to designate the official standards of client services to be
pursued by the facilities of the Texas Department of Men-
tal Health and Mental Retardation and community men-
tal health and mental retardation centers.
405 732. Apphcation The provisions of this sub-
chapter apply to all facilities of the Texas Department
of Mental Health and Mental Retardation and commu-
nity mental health and mental retardation centers estab-
lished pursuant to Texas Civil Statutes, Article 5547-203.
405.733. Definitions The following words and
terms, when used in this subchapter, shall have the fol-
lowing meanings, unless the context clearly indicates
otherwise:
Accreditation-The state of being publicly or offi-
cially sanctioned as conforming to prescribed or desira-
ble standards.
Center-A community center for mental health
and mental retardation services established pursuant to
Texas Civil Statutes, Article 5547-203
Facility-Any hospital, state school for the men-
tally retarded, state center, research institute, or other in-
stitution of the Texas Department of Mental Health and
Mental Retardation or any organizational entity that may
be hereafter made a part of the department.Governing body-The Texas Board of Mental
Health and Mental Retardation.
Plan of correction-Written response to internal
or external quality assurance surveys which states the
specific actions taken or planned to correct deficiencies,
the person responsible for corrective action, and the an-
ticipated date for compliance.
PSRO-Professional standard review organiza-
tions.
Quality assurance-The overall goal of ensuring
the provision of optimal client services. Movement toward
this goal is a continuous process involving measurement
of the level of client care relative to norms, criteria, or
standards, and taking corrective action to eliminate iden-
tified deficiencies.
405.734. Scope The Texas Department ot Mental
Health and Mental Retardation assumes responsibility
for:
(1) pursuing high quality of client service and im-
provement in the level of service of the facilities and pro-
grams affecting clients through an integrated quality as-
surance program;
(2) assuring highest quality client service de-
livered in community mental health and community men-
tal retardation centers through performance contracting
and standards compliance monitoring;
(3) providing for the establishment of a safe liv-
ing environment for clients, safe working environment
for staff, and reasonable safety for visitors to facili-
ties/centers;
(4) achieving facility and center compliance with
applicable regulations (i.e., local, state, and federal sta-
tutes; and rules of the department);
(5) providing evidence (e.g., accreditation, certi-
fication, delegated review status, summary data from
quality of care reviews and utilization reviews, and
documentation of service improvement resulting from
quality assurance activities) to consumers and funding
agencies of an effort to deliver an optimal level of ser-
vice to all facility and center clients;
(6) actively pursuing compliance with court
agreements concerning client services;
(7) providing program and services evaluation on
a systematic basis for all client services at TDMHMR fa-
cilities;
(8) cooperating with the designated Texas PSRO
agency to achieve the highest review evaluation possible
for each facility.
405.735. Standards of Care. The Texas Department
of Mental Health and Mental Retardation embraces the
current edition of the following standards as integral to
quality client services in facilities and centers:
(1) Joint Commission on Accreditation of Hos-
pitals (JCAH) standards-standards contained in JCAH's
Consolidated Standards for Child, Adolescent, and Adult
Psychiatric, Alcoholism, and Drug Abuse Faciltles or Ac-
creditation Manual for Hospitals (when applicable) for
mental health facilities.
(2) Medicare standards-federal standards gov-
erning conditions of participation for hospitals serving
Title XVIII clients in mental health facilities, as contained
in 42 Code of Federal Regulations 405, Subpart J.9 TexReg 1691
