Emergency
Rules An agency may adopt a new or amended rule, or repeal an existing rule on an emergency basis,
if it determines that such action is necessary for the public health, safety, or welfare of this state.
The rule may become effective immediately upon filing with the Texas Register, or on a stated date less than
20 days after filing, for no more than 120 days. The emergency action is renewable once for no more than 60 days.

The Comptroller of Public Accounts
adopts on an emergency basis an amend-
ment to an emergency amendment to
3.544, concerning definitions. The
original emergency amendment was
published in the May 8, 1987, issue of the
Texas Register (12 TexReg 1486). The
amendment amends the definition of
bingo equipment and supplies.
The amendment is adopted on an
emergency basis to allow licensed au-
thorized organizations to purchase fromsuppliers other than licensed manufac-
turers and distributors items generally fur-
nished in the rental of a public hall, thus
allowing the purchase of these items at
the lowest available price, leaving more
money available for use for charitable
purposes.
The amendment is adopted on an
emergency basis under Texas Civil Sta-
tutes, Article 179d, which provide the
comptroller with the authority to
prescribe, adopt, and enforce rules
relating to the administration and en-
forcement of the Bingo Enabling Act.
3.544. Definitions. The following words
and terms, when used in this chapter, shall
have the following meanings, unless the con-
text clearly indicates otherwise.
Bingo equipment and supplies-Items used,
made, or sold for use in bingo games.
(A) Bingo equipment and sup-
plies include:
(i)-(iii) (No change.)(iv) any other device[, in-
cluding a television monitor and display sys-
tem,J commonly used in the direct operation
of the game.
(B) (No change.)
(C) Bingo equipment also does
not include furnishings generally provi::d in
the rental of a hall regardless of whether or
not bingo is conducted, such as:
(i) a television monitor system,
a television camera, or a television set;
(ii) a public address system; or
(iii) tables and chairs.
