Code of Criminal Procedure, Article 42.13. 6c, (Senate
Bill 368). and shall serve as resource for recommenda-
tions to the Commission on Alcoholism's governing
board.
153.2. Objectve. The intent of the commission, in co-
operation with DPS, SDHPT, and TAPC is to provide
written rules, regulations, and standards reflecting mini-
mum standards for the uniform operation of programs
designed to rehabilitate persons w ho are placed on pro-
bation for misdemeanor dris ing u\ hile inroxicared or oth-
ers who are required to attend such programs. T hese rules
will establish the minimum acceptable level of quality for
DWI education programs in Texas.
153.3. Scope of Rules, Regulatons, and Stan-
dards. An] agency, organiation, or indis dual which
operates a program designed to rehabilitate persons who
are placed on probation for misdemeanor driving while
intoxicated or others who are required to attend such pro-
grams may obtain program certillcation from the com-
mission. The rules, regulations, and standards should be
reasonably enforced and shall not be construed to enlarge,
diminish, modity, or alter the jurisdiction, power, or au-
thority of the commission.
153.4. Program Cerlfication. A certificate issued un-
der this Act expires two years from the date of issuance.
A program seeking certification must comply with the
provisions of this Act and with the rules, regulations, and
standards of the commission adopted under this Act. Pro-
grams seeking initial certification must establish that a
need which is not being met exists in the proposed coun-
ty or counties to be served and must provide proof of
support for the program from the appropriate adjudicat-
ing courts) and probation department(s). A certificate
may be issued when the commission receives a completed
prescribed application form. The certificate will become
effective on the date of issuance. A program may be mon-
itored by the commission or its designated representative
prior to issuing program certification or during the two-
year certification period. Certified programs will be listed
as potential referral schools in the Statewide DWI Educa-
lion Program directory. Noncertified programs are not
eligible to receive referrals. Apphcations for certification
are available from the commission's Statewide DWI Edu-

153.5. Certification Renewal. A certification issued
under this Act expires two years from the date of issuance.
The commission shall issue a recertification notice 30 daysprior to the expiration date of the certificate. A renewal
certificate may be issued upon recei ing a completed ap-
plication form prescribed by the commission prior to the
expiration date of the certificate A program iima be mon-
itored by the commission or its designated representatis e
prior to renew ing the program's certification. Any appli-
cation rece sed alter the renewal date shall be treated as
a new application lor certification and shall be submit-
ted as a new application to the commrisson's Statewide
DWI Education Program Director, Texas Commission
on Alcoholism, 1705 Guadalupe (Eighth Floor, Sam
Houston Building), Austin, Texas 78701.
This agency hereby certifies that the proposal has
been reviewed by legal counsel and found to be within
the agency's authority to adopt.

The Texas Commission on Alcoholism proposes
amendments to 153.31-153.34, 153.36-153.38,
and 153.41, concerning the DWI Education Program
standards and procedures. The proposed amendments
are in response to Senate Bill 1, 68th Legislature,
1983, so the standards will be in conformance with
the new statutory requirements. The proposed amend-
ments to the standards will assist the certified educa-
tional programs designed to rehabilitate misdemeanor
driving while intoxicated offenders in complying with
the necessary statutory requirements imposed by Sen-
ate Bill 1, and will further clarify and define what is
expected from these programs to assure quality
education and uniformity in programming statewide.
Larry Goodwin, Fiscal and Administrative Services Di-
vision administrator, has determined that for the first
five-year period the rules will be in effect there will
be no fiscal implications for state or local government
as a result of enforcing or administering the rules.
Mr. Goodwin also has determined that for each year
of the first five years the rules as proposed are in ef-
fect the public benefit anticipated as a result of enforc-
ing the rules as proposed will be continued high quality
education and standardization in instruction provided
to the DWI offender by the certified and approved DWI
education programs, There is no anticipated economic
cost to individuals who are required to comply with
