The Texas State Board of Dental Examiners proposes
new 109.201, concerning definitions of false and
misleading advertising.
William S. Nail, executive director, has determined
that for the first five-year period the rule will be in ef-
fect there will be no fiscal implications to state or local
government as a result of enforcing or administering
the rule.
Mr. Nail has also determined that for each year of the
first five years the rule as proposed is in effect the
public benefit anticipated as a result of enforcing the
rule as proposed will be public protection from false
and misleading advertising. There is no anticipated
economic cost to individuals who are required to com-
ply with the rule as proposed.

The new rule is proposed under Texas Civil Statutes,

ing. Although any dentist may advertise, no dentist shall
advertise or solicit patients in any form of communica-
tion in a manner that is false or misleading in any material
