Rights-of-Way Over Public Lands
31 TAC 13.11
The General Land Office proposes an amendment to
13 11, concerning rights of way over public lands
The proposed amendment eliminates reference to a
specific filing fee for right of way easement, allow-
ing the commissioner flexibility in setting a fee based
on the costs of processing the application
Mike Hightower, Land Resources Program manager,
has determined that for the first five-year period the
rule will be in effect costs of administering the rule
will not be affected, but the revenue received by the
General Land Office will be raised or lowered accord-
ing to the filing fees established by the commissioner
Mr. Hightower has also determined that for each year
of the first five years the rule as proposed is in effect
the public Denefit anticipated as a result of enforcing
the rule as proposed will be a more equitable filing fee
based on the processing costs of the easement
charged to lease applicants, thus defraying agency ex-
penses formerly borne by the general public. The an-

The General Land Office proposes new 13.17 and
13 18. concerning fees for right of way easements
and fees for surface leases for certain facilities The
General Land Office is submitting these rates as rules
of the agency for the first time
Mike Hightower, La,)d Resources Program manager,
has determine(, that for the first five-year period the
rule will be in effect there will be fiscal implications
as a result of enforcing and administering the rule The
effect on state government will be an estimated in-
crease in income of $552,650 66 for each of the next
five years as a result of increased filing fees and ease-
ment contract fees Of this amount, $544,680 66 will
be deposited in the available school fund to support
public education in Texas The remainder will be reap-
propriated to the General Land Office to cover
operating expenses The increased income, if any,
from surface leases for certain facilities cannot be
estimated since one of the new means of determin-
