D. Judicial Board
1. Membership to consist of six faculty members nominated by the Faculty
Committee on Committees and Govenence and elected by the faculty,
and three student members elected by the student government.
2. Functions:
a. To hear cases appealed to it from the Student Supreme Court or
from the Deans of McMurry College as specified in II, D, 5.
b. To clarify judicial procedures.
SECTION II: Judicial Process Guides
A. Announcement of regular sessions for hearings: Each judicial body
established herein is to announce regular meeting times.
B. It will be the duty of the presiding officer of each judicial body or in the
absence of the presiding officer a designated deputy to place each request for
hearing on the agenda of the next regularly scheduled meeting of that body, provided
that in all cases twenty-four hours notice of the hearing shall be given to all members
of that judicial body. It shall also be the duty of the presiding officer of the hear-
ing body, or in the presiding officer's absence a designated deputy, to provide that
such relevant background information as may be necessary for any hearing shall be
made available by such administration officers of the college as may be concerned
in the case.
C. Emergency Sessions: Some cases may require meeting at other times
in emergencies due to the lateness of a semester or an approaching holiday recess.
Each hearing body is expected to permit a defendant at least twenty-four hours
written notice prior to hearing his or her case: however, a shorter notice may be
agreed upon between the defendant and the presiding officer of the hearing body.
D. Effective Judgments
1. Each hearing body's judgment is effective at the time such judgment is
verbally rendered by the body's presiding officer subject to appeal. In
case of appeal, judgment shall become effective only with final dispos-
ition of the case in accordance with the time limits specified in McMurry
form 1970.02.
2. Written confirmation of each judgment, original or appeal, will be
provided the defendant within 48 hours and will become a part of the
RECORD OF JUDICIAL HEARING AND ACTION, McMurry forms
1970.01 and 1970.02, to be placed in the Judicial Proceedings file in
the Student Life Office and to be placed on file in the records of each
of the courts through which the case has moved.
3. Each student whose case is heard by any of the judicial bodies of the
college, except the President of the College, shall be notified in writing
at the time the decision is rendered by a representative of that body of
his right to appeal the decision. Copies of that letter shall be sent to
all the relevant appellate bodies.
E. Jurisdiction
1. Resident students involved in alleged misconduct within the residence
hall (or in activities connected with them) are to be heard by their
respective Residence Hall Executive Councils. Initial appeals go to the
Student Supreme Court, with the Judicial Board and the President of the
College following in the appellate sequence.
a. The following offenses committed in and around the residence halls
are included in the initial jurisdiction of the Vice-President for
Student Services:
1. acts of physical violence committed upon another person.
2. Theft.
3. possession or sale of narcotics or legally controlled substances.
4. illicit visitations as outlined in the McMurry Housing Policies.
b. Penalties that may be used by the Dormitory Councils for offenses
within their jurisdiction are restricted to the following:
