House Bill 158, Aots of the 51st Legislature,
provides :
"'8eotion 1. That hereafter every
owner of any tract of land situated within
the corporate limited, or within five miles
of the corporate limits of any oity in the
State of Texas, who may hereafter divide
the some in two or more parts for the pur-
pose of laying out any subdivision of any
tract of lend . . . shall oause a plat to
be made thereof whioh shall accurately de-
scribe all of said subdivision or addition
by metes and bouads and locate the same
with respect to an original coroer of the
original survey of which it is a part, gir-
lng the dimensions thereof of said subdivi-
sion or addition, and dimensions of all
streets, alleys, squares, parks or other
portions of same intended to be dedicated
to publio use, or for the use of purchasers
or owners of lots fronting thereon or ad-
jacent thereto; provided, however, that no
plot of any subdivision of any treat of
land or any addition to any town or city
shall be recorded unless the same shall aso-
ourately describe all of said subdivision
or addition by metes and bounds and locate
the same with respect to an original corner
of the original survey of whiah it is a
jart giving the dimensions thereof of soid
sdbdivision or addition, and dimensions of
all strets, alleys, squares, parks or
other portions of same Intended to be de-
dioated to public use, or for the use of
purchasers or owners of lots fronting
thereon or adjacent thereto."
In construing the provisions of House Bill 158,
it wes held in AttPrney General's Opinion No.V-919, a
oopy of which is enclosed, that the portion of House Bill
158 requiring subdivisions or additions to be located
with respect to an original corner of the original survey
of which it is a part is in violation of Section 35 of
