Section Ci. All puhlic roads and high-
ways that have heretofore heen laid out
and established agreeahly to law except
such as have heen discontinued are
hereby declared to he puhlic roads ami
the said commissioners' court shall in
no instance grant an order or an appli
cation mr anv new roan or in iiiscon-
tiuue an original one unless the per-
sons making applications for the same
or some one of them shall have given
at least twenty days' notice by adver
tisement of their intended application
posted up uf the courthouse door and
two other public places in the vicinilv

Section". All applications for a new

pointing toward the most noted places
lo which the.v lead ; and on failure to

or index boards w ithin six months
after their appointment the overseer of
such roads lor such failure and neglect
shall be liable to indictment and on
conviction thereof before any court of
competent jurisdiction shall be lined in
the sum of live dollars and all costs of
prosecution.
Section "Jo If any person subject to
road duly shall refuse to serve as over-
seer oh any road in his district agree-
ably to llm order of the court ill the
county in which he resides he shall be
deemed guilty ofa misdemeanor and
on conviction thereof before any coiirl
ol competent jurisdiction shall be lined
ill a sum not less than leu nor more
than forty dollars; provided nil reason-
able excuses shall be heard and nlhiw-
i d by the court Irving the same. And
it shall be the duty of every person n

such order is made shall issue a notice

worked by the road hands as in the
case with other roads in the county.

any person through whose land a third-
class road may run shall have the right
to erect agate or gates across such road
or roads said gate or gates to be ten
feet wide nml hung so that no person
on horseback can open and shut it with-
out alighting front his horse mid any
person w ho shall leave said gates open
shall In; guilty of a uiisileineaniir and
ou conviction thereof shall be tilled ten
dollars for each oU'ensc and shall also
be responsible to the owner for any
damage that may be incurred lliereby
to be recovered in any court of compe-
tent jurisdiction.
