shallow- stream as the boundary line
between it and a. people who cherished
a traditional prejudice toward the
American people intensified by the
Texas revolutjou for independence and
the international war of 1S4I1 1 in-
mriicted the extradition iigent repres
senlilig this state under tho special pro-
visions of the treaty of December 1 1
iSiil to demand: First the prisoners
released irrespective of nationality be-
cause having committed the crimes of
theft and murder on Texas territory
w ithin organized counties and having
been legally indicted by tho grand
juries of said counties arrested by the
high sherill's under proper capias of the
courts lodged in jail in default of bail
the jurisdiction ol the criminal courts
of Texas hud already attached and the
clause .of the treaty excepting citizens

by an unlawful mob without the con-
sent of this government and the repub
lie of Mexico should place them back
within her power in their original po-

The extradition agent also demanded
in an able and exhaustive paper the
delivery to the Texas authorities of the
outlaws engaged in this all iir as an act
ot comity towards u neighboring and
friendly republic.
In this demand the governor of Tain-
nulipas (General t'anales) did not eon-
eur nor did any one of the local civil
or military authorities of Taimmlipas
iiml did refuse to become (he instru
inents of extraditing nny party charged
with crime in Texas fleeing to Mexico
mid who claimed to be simply of Mexi-
can origin.

tives from Texas wero turned loose
without any issue of citizenship being
mooted even inucli less tried; hut the
very proposed identification of the crimi
nals was denied and tins done too be
it remembered in a city from which
Canales had departed with his state
troops! done under the guns of the
fort mid in the presence it was thought
of over a thousand regulars from the
Central government!
1 cannot lad to call attention of the
United States jjovcrnnient to the fact-
undisguised that Garza nnil the ban-
dits who released him havo been ami
tiro now iu mid around C'ainargo in sight
of the very spot on which they shot
lowu innocent men and women and ro-
eased murderers from the jail !
It is u fact likewise well known that
Ksproneedu and the two others who
were delivered at midnight opposite
Matamoros were friendless 'and home
less vagabonds who it appears had de-
predated us much upon Mexican as
upon American citizens ; but Garza and
the other outlaws are noted desperas
Iocs and representative) men of their
iss perhaps owning ranches near
C unargo and beyond have never been
molested or in danger oi arrest by tho
Mexican military or civil authorities.
In the presence of these facts and
when advised that now and henceforth
demand for fugitive from justice
would bo to re-enact a tiolemn farce at
the expense of the pride ami dignity
ami honor of Texas I dirocted that
until further orders no more efforts
should be made for extradition under a
treaty ignored on the one part but
which has always been observed iu
earnest good faith toward the sister re-
uhlie by the state of lexas and by the
general government.
e have no assurance ol peace and
security along the Mexican border nor
have wo had such security since the
Mexican war and the annexation of tho
republic of Texas as a state to the
Amcucun union.
Aside from the general obligation iin-
ptijied by the federal constitution upon
this government to protect the exposed
frontiers of Texas along with the other
states the special stipulations ot the
treaty of annexation doubly imposed
this duty upon tile United States be-
cause ot her liability to Indian forays
and Mexican iuvauons nlong a frontier
of over many hundred milesjn extent.
In obedience to this moral ami legal
obligation the United States governs
ment has established forts and posts
ami lias since IM" attempted to give
protection to that frontier. The num
ber of troops reouired and especially
of cavalry has always been inadequate
to the heavy task imposed upon the
portion of the regular army assigned to
that duty. I he consequence has heen
that the state of Texus has sull'ered
alike from depredations from predatory
Mexican freebooters as well as from hos-
tile Indians for thirty years so much
so that prompted by the instincts of
self-preservation and the cry which
conies from the border unceasingly
during all these yerrs for protection
the legislature of my state has been
forced to place their own militia in the
Held at a cost of nearly two mil
lions ol dollar since IS hi to the
present time. While our sister states
of California ami Oregon for similar
expenditures iu maintaining state
troops to guard against Indians have
been repaid by our government it has
been the misfortune of Texas to have
never yet received any recognition ol
the just claim upon a great mid mag-
nanimous government and of which
she forms no inconsiderable part. I
will I trust be excused for this partial
digression because it is pertinent to the
renewed appeal which 1 now make for
the state of Texas to the government
under which she lives that we slutll
have material and complete protection
on our Mexicau frontier (mr people
are miir b-red their property stolen
md with but rare exceptions our
claims for redress are met with indill'er-
ence or our demand for fugitive
thieves and murderers laughed to scorn
loin the opposite shore of a shallow
river and almost in sight of their vic
thus!
1 can not now rtcount this long cata-
logue. I beg however to ha ve considered
in this connection the exhaustive report
upon "Texas Border Troubles" ol the
special committee of the forty-fourth
congress consisting of Hon. Messrs.
Schleicher Williams Ranks Hurl-
nurt and Lamar as a part of thin.
In that most able and comprehensive
report the wrongs which Texas has suf-
fered from Mexico unred reused are re-
counted with a faithful and true hand
and it constitutes a chapter in our his-
lory which I pray God may never again
be written. . .
I beg also to refer you to the joint
resolutions of every legislatuie of Texss
since l4i asking for more adequate
protection and to the annual messages
of my honored predecessors in the exe-
cutive office each and all of them filled
ilh evidences of bad faith and hostil-
ity of our Mexican neighbors toward
the Texas people.
