vorce suit of Theresa Fair vs. Juuios l"
Kalr came up in the district court this
morning. H. 8. Merrick appeared lor the
plaintin and M. N. Hlone of this city and

the defendant. Stone submitted a general
demurrer to the complaint on the ground
that the facts stated are not sultleioiit to
constitute a cause of action. The demurrer
"was submitted without argument and ut
once conceded bv the court. Stone tlionsaicl
the defence would lile no answer to the
complaint. Merrick naked the court to ap-
point a time to-day to hear proof; also i hut
the examination he conducted privately.
The court appointed 12 o'clock and when
the court met all the reporters were ex-
cluded. Iu less than an hour an attorney
came out aud it was soon known a decree
ol divorce had been granted as prayed lor
nd plaintih" allowed $lL'50nw) in money
aud United States bonds and the family
residence in San Francisco; also the custody
of her three minor children. The custody
of the oldest boy James was awarded to
defendant. The senator arrived this morn-
ing from Ran Francisco on business con-
nected with the sale of the Brunswick mill
aud the trauster of the Yellow Jacket mine
to the Tlinron party. A tmnsler of the
entire business will take place about the
ond ol the presen month.

Wahiii!uiton May 13. The growing
scarcity of ranges for grazing purposes in
the southwest has Induced a number of per-
sons eugnged in stock-raising to ninke con-
tracts for grazing lands lu the Indian terri-
tory and between 3000000 and t000(XH)
acres of land have been leased from dill'erent
tribes. latoly lands have been leased from
4lio Cheyenne and Arapahoe Indiana at an
annual rental of two cents an acre. The
parlios leasing the lands want the govern-
ment to approve the leases. Secretary Tel-
ler of tho interior department lias written
a letter refusing such approval. In his let-
tor the seorelury says tho government lias
no objection to the leasing of luuds by the
Indians but will see to it that no improper
characters are admitted Into the territory
and also that the rent is promptly pal''.
The secretary advises that the runt' be puiu
in oat le and that tho Indians be taught
liow to herd cattle in order that tliev innv
receive employment as herders and nlso
that they may become stock-raisers. The
reason tho secretary gives for not approving
the lease Is that it may become necessary
for the government to order the lessees out
