thought lhat either Mr. Davis oi
Governor Hobby voted for Ablleno.
Later ft motion prevailed to mike
the vote unanimous for Abilene and
by a viva voce vote the motion pre-
vailed. A mollon then prevailed requir-
ing Abilene to execute a $60000
bund conditioned that the City or
Abilene should carry out certain
agreements as to the water to be .
furnished the college etc. The
board then adjourned subject to tho
call of the chairman.
'Shortly arter the adjournment of i
the Hoard. I wns Informed that Lieu- j
tenant Governor Hobby and Comm.
hloner Davis had made statements as
to how they had voted and was (
requeued by certain newpapers to
make a similar statement. I flrst de-'
cllned to make any statement what-
ever because of the agreement for
an executive session. However when
I lea mod that It was true that Com
mlssloner Darls and Governor Hob- (
by had made statements with refer- (
ence to their votes I stated to the
pre that I did not vote for Abilene
and on the same day advised several
of my friends living at Snyder and t
other places lhat t voted for Has-
kell on the flrst ballot and Snyder on
The second ballot. (
I returned home on the 30th of
June and on the 1st day of July I j
wired ft delegation of ci I liens from (
Ban Angelo and Lubbock then In
Austin that 1 favoreiPa reconven.
Ing of the board.
On July I I wired Gov. Ferguson (
that I would be In Austin the follow-
Ing Friday Tor a conference with him
andon the same day wrote Gover-
nor Hobby and Commissioner Dav-
it urging upon them 'the necessity
of having the board reconvened. I
On July 3rd 1 wired Governor
Hobby that I would be In Austin on j
tho following Friday morning and
requested him to meet me there. On
July 4. Governor Hobby advised me
by wire that If 1 wanted to haft a
meeting of the Board Id Austin on
Friday he would go but auggested
that I meet him In Houston Thurs-
day and discuss the matter and de-
termine. If necessary to go to Aus-
tin; and on the same day I answered
him by wire and requested that he
meet me at te llrasos hotel at I
o'clock Thursday morning but fail-
ed to. meet Governor Hobby I have
been advised since that time that
Governor Hobby did not arrive at the
hotel on time and for some reason
we failed to meet. The proof Is1 evi-
dent however that our failure to
meet waa an accident.
I went on to Austin Thiysdsy
morning. Friday morning I called
on the Governor and tried to pre-
vail on him to reconvene the board.
After several conferences with tho
Governor with reference to recon-
vening the Hoard the Governor fin-
ally stated that he had had a con-
ference with Governor Hobby the
day before at the Rice Hotel In
Houston Texas In which conference
Governor Hobby had Indicated that
he thought that the location was
fair honest etc and that Governor
Hobby did not favor reconvening
of Ihe board and the Governor sug-
gested that he thought It waa for
the best Interest of the college that
tho'matter be not reopened but that
the Hoard Jssue statement which
the governor had prepared to the
effect that the selection of Ablleno
was fairly made etc. The governor
stated that this proceedure would
meet with absolute approval of Oov. '
Hobby and that Hobby would give a
dollar to sign the statement per-1
sonally. I
So far as the election appeared to !
mewhlle I did not see the ballots 1
yet upon Its race everything ep-1
peared to be regular honest and rnlr '
and as Governor Hobby as I thought '
desired to clone the matter by the
Issusnce of the statement. 1 advised
the Governor to call In Commission- j
er Davit and Superintendent Doughty
for a conference on the question. In
the Conference Supt. Doughty and
Commlmloner Davis thounht thnt It
was the proper thing to do to Ishuc '
such a statement provided Gover-
nor Hubby would aign same. Supt. '
D'.URliiy speolnlly protested nunlnm j
nor llnl.hy. who waa then In lloui-
toti would Join In the slittemcnt.
The Governor advised Mr. Dough-
ty thnt Oovernor Hobby would be
anxious to nlfrty the statement and
lhat he would calhGovernor Hobby
over the phone and get permlnslon to
affix his signature to same. With
this anurnnce the statement was
slcnod. At no time waa tho commit-
ter advised that Governor Hobby
would mnke any reservation In sign-
ing the statement.
CommiMloner Davljold the com-
tytteo that he had made certain
piOiulnes as to an affidavit and that
If Afoe waif demanded ha would
give the affidavit but he left the
Impresitjon with the committee that
unless in me waa demanded of him.
he did 4"t expectVto file an affidavit
At bip conclusion of the meeting
Commissioner Davis handed Gover
nor Kerb u ton some kind of an In
strumentnnd told tho governor was
his retei eation In case the affidavit
was demanded. The Instrument hand-
ed to the Governor was not read
either by Huperlnledent Doughty or
mynelf.
Immediately upon adjournment of
this meeting Commissioner Davis
gavo out the Interview slating that
he signed Ihe statement with the
reservation thnt three members
would not mnke affidavits that they
voted for Abilene on the first and
second ballots; and Governor Hobby
a I ho telephoned from Houston to a
press correspondent that he author-
ised the execution of the statement
with the understanding that three
members would not file affidavits
lhat they voted for Abilene.
When this natter was called to
my attention I again sated to my
friends as to how I had voted on the
first and second ballots and sated to
the press that I was willing to make
my affidavit that 1 did not vote for
Abilene on cither the first or sec-
ond ballot and Uiimedlalely there-
after executed an affidavit to that
effect
I have recently had t conference
with Governor Hobby and ho In-
forms mo thnt Governor Ferguson
told him over the telephone on the
day Ihe statement mas signed thnt
I had admitted to him having vot-
ed for Abilene and Governor Fcrgu-
son thought It would be best for .
them all to Issue statement so the
matter would be dropped. I hnye.no I
doubt that Governor Ferguson mauo
the slatement to uovornor noooy.
The statement that I voted for ao- ;
llene on eitner me nrsi or aecono ;
oauot is an unquaiuira laiaenooa
and no one has any better reason to
know It than Govejftr Ferguson. I
have sought In ever 1 iy to have the
matter reopened an civ would have I
continued to Insist upon II In Austin
excepts for the facts above stated.
To leave the matter In Its present
form when three members of-fhe
board have signed affidavit show-
Ing that there waa a mistake in IhM
original count or deliberate fraud fs
a disgrace to the State ft there
was a mistake In the count It li a
fraud now upon the people of this
b'tate and on the Committee for the
Governor to fall to recall the com-
mittee for a fair and open vote as to
the location.
I am giving this statement to the
press so that the people of thir
State may know the facta Id refer-
ence to the matter of location of
this institution. '
