of town should the Waters Pierce Oil
Co get afire with tbe chances of its
Immense oil tangs bursting. Tbe cap-
acity of these tanks is about as fol
lows:
One 1S0CO gal tank with Euplon oil.
One 10000 gal tank with gasoline.
Two 5000 gal tanks with headlight
besides their warehouse filled with case
and barreled oil.
The greatest danger lies In the fsct

create such a great heat and with
bursting tanks no doubt would de
stroy tbe new tlectrlc Light Com
pany's plant taking in tbe bottling
works tbe depot tne joint warehouse
gas and old electric light works and
thereby leaving the city la darknts.

ing of tbe hose off of the Santa
plug. Of course these are surmises on-
ly but are not ionposelbllitlos.
At the big oil fire In N J where
there waa a loss of $10000000 tbe oil
tanks burst and tbe firemen resorted to
trenoblog to keep tbe burning oil from
running everywhere.
There are no doubt other pltces in
tbe city where an exfa plug could b

pany several years ago was brought
up for trial yer-terday afternoon before
a jury In Justice Spender's court.
It took all arternoon to near toe
evidence and court then adj turned
until 9 this morning when the case was
argued by County Attorney Ey ler aod
Jay Good for the state and Millard
Patterson for Uastro.
Tbe jury after be.ng out for about
an hour returned a verdict of guilty
and assessed tte flee at 91 and costs.
This is considered quite a victory for
Mr. arder.
The facts of the case are In brief as
follows. Mr. Warder It will be re-
membered filed a suit a few weeks
ago la the federal court for tbe greater
part of tbe land lying north or tbe
river up to Second street. Tbe suit
Involves over tl. 000000 worth of prop-
erty. Warder leased a certain plct of this
land to a Mexlcen woman and her
brother-in-law built a little shanty oo
tbe lot. But Judge A. M. Loomls bad
purchased tbe lot from the Campbell
Ilal Estate company several years
ago and bad given no one permission
to built any kind of a but or house oa
the ground so wben he found that
tbere was a little building on tbe place
he sent hts agent Frank Alderete and
several Mexican laborers down to te
it down which tbey did.
Tben the Mexican made the com-
plaint sgaiDst Judge . Loom's Frank
Alderete. Martin Castro acd others
and the first case called was tbe Castro
case with tbe above result
the price trial.
Tbe Price trial is still occupying
tbe attention of the dUtrlct court but
a verdict may be rendered by tbis
evening for the lawyers were arguing
tbe case tbis forenoon and as tbere are
only four engaged in tbe case tbe
judge ought to deliver his charge
before nlgbt.

THE DAM QUESTION
Is Being Taken Up In th Washing'
ton Departments Owing To tbe
Activity Of Our Cbamber Of
Commerce
The following is a copy of a letter
written by the acting commissioner of
the general land office W. A. Richards
to the secretary of the interior under
date of last Saturday and transmitted
to the El Paso chamber of commerce
on the same date:
Washington October 6.
The Honorable The Secretary of the
Interior.
Sir: I have the honor to acknowl
edge the receipt by your reference of
a letter of Ernest E. Russell secretary
of the chamber of commerce. El Paso.
Texas transmitting copy of a resolu
tion of that body I Referring to the
Rio Grande dam question).
The department approved the right
o way for the Iiio Grande Iam and
Irrigation company's reservoir on Feb
ruary 1. lSDo. aul the legal proceedings
to restrain it from constructing the
resrrvoir were subsequently begun and
are now under the jurisdiction of the
department of justice. This ollice is
not informed of the status of the case
at the present time but it is known
that the matter has been considered
by the U. S. supreme court and that
the case has been remanded to the
lower courts for further action (174
v. S. 6110).
The questions in this case are of
considerable importance in the devel-
opment of irrigation and involve also
matters relating to the treaty of Guad-
alupe Hidalgo in which the depart-
ment of state is interested as the gov-
ernment of Mexico has claimed that
its interests will be afrected by the
construction of the dam and the di-
version of the water.
Furthermore in pursuance of de-
partmental order of December' 5
18HG. all applications for right of way
for canals or reservoirs which require
the use of the waters of the Rio Gran-
de have been suspended. Some of them
have been awaiting action since earlv
in 1S97.
In view of the foregoing it is evi-
ent that an early decision of the case
is very desirable. I therefore enclose
Mr. Russell's letter and recommend
that it be forwarded to the depart-
ment of justice with the request that
such action may be taken as will se-
cure an early decision of the case.

For the Carnival-
The executive committee of the Mid-
winter Carnival met at headquarters
last evening and transacted much busi-
ness of a routine character.
Among other things done the prop-
ositions from fire works people to ar-
range for the display on Mount Frank-
lin was referred to a subcommittee
for an investigation and report.
The following communications ex-
plains itself:

To Officers and Members Central La-
bor Body El Paso:
Gentlemen: The executive commit-
tee of the El Paso Midwinter Carnival
association desires information as to
the progress of the work of organizing
labor unions. The place in the execu-
tive committee of the Carnival assor
ciation remains unfilled and it is de-
sired that the representatives of the
several labor organizations of the city
be appointed as soon as is possible.
If the method for selecting such rep
resentative as suggested by the carni-
val committee is not clearly under
stood the following explanation may
be useful:
It is desired that each organization
or union in this city select a delegate
When these delegates have been chos
en they meet together and elect a
chairman and the chairman will be
made a member of the executive com-
mittee of the carnival association. And
the body represented by the unions cf
the city that is the "We Will" labor
committee becomes a sub-committee of
the carnival association to direct and
carry on that branch of tbe work re-
ferted to it by the central executive
committee .
I recommend that your body urge
all affiliated bodies that have not al-
ready acted to do so at the earliest
dat-.i. in order that the commitree orga-
nization of labor representatives may
be completed. Very truly

The We Will Entertainers.
Several members of the "We Will
Entertainers" met last night in an-
swer to a call from the president and
organized for the vaudeville which is
to be given two weeks from today.

This is the first of a series of en-
tertainments to be given by the WE
WILL Entertainers for the benefit of
the Carnival fund. From the above
program the public will at once recog-
nize that some of the best talent in
El Paso will participate in the enter-
tainment. The boys have been greatly
encouraged in their work by so many
offering their services and the clubs
membership list has now reached over
00 and still more are joining every day.

Notes.
Two expert float builders who have
constructed floats in St. Louis New
Orleans. Fort Worth. Dallas and other
points were before the committee last
night to contract for the building of
the floats for the gorgeous Carnival
parade.
Among the labor organizations that
have already endorsed the Carnival
movement are the following: Knights
of Labor. Order Railway Conductors
Decorators. Typographical Union and
the Central Labor body. Many mem-
bers of the organization are earnest
workers.
Superintendent A. S. Greig of the
Northeastern has telegraphed the Car-
nival committee that Alamogordo's
company of the national guard recent-
ly mustered in seventy-five strong is
drilling nightly in anticipation of the
Carnival and will be glad to offer its
services to the committee free of
charge. The company will also enter
the competitive drills. Furthermore
citizens of Alamogordo will contribute
a handsome and costly float to the
"Parade of the Centuries."
