Chapter 1149 H.B. No. 2004 1 AN ACT 2 relating to the sale of certain state property in Brazoria County by 3 the Texas Board of Criminal Justice. 4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 5 SECTION 1. (a) Not later than December 31, 2011, the Texas 6 Board of Criminal Justice shall sell the real property described by 7 Subsection (c) of this section if the board receives a bid of at 8 least $5.5 million for the property. 9 (b) The Texas Board of Criminal Justice shall sell the 10 property as provided by Section 496.0021, Government Code. The 11 General Land Office shall negotiate and close a transaction 12 involving the real property described by this section on behalf of 13 the board using the procedures under Section 31.158, Natural 14 Resources Code. The sale shall exclude the mineral interests in and 15 under the property, and the deed shall contain a provision 16 expressly reserving the state's interest in and right to remove all 17 oil, gas, and other minerals in and under the real property 18 described by Subsection (c) of this section. 19 (c) The Texas Board of Criminal Justice shall sell the real 20 property described as follows: 21 Approximately 2,200 acres, more or less, being part of that 2682 22 acre tract or parcel of land conveyed to the Prison Commission of 23 the State of Texas as recorded in Book 145, Page 307 of the Deed 24 Records Brazoria County, Texas, said 2,200 acres, more or less,
