not read the deeds but saw them While
Alex had them. When the witness

stract defense objected wns over-
ruled and defenso excepted. With this
the witness wns excused and the

Then the state attempted to Intro-
duce as evidence tho applications and
"stibpoehaes issued on the 27th of
March but the defense objected and
was sustained by tho court. On. this
the state :asked whether the checks
made payable to Mrs. Barnett mother
of defendant and nlso tho. one Intro-
duced and made payable to Miss Eula
Barnett. Both of these checks signed
by the defendant. The defense objec
ted t othe introduction 01 me coccus
but tho court allowed the one made
payable to Miss Eula Barnett to oe
introduced while the other was not
allowed. The tiheck to Miss Eula Bar-
nett was dated the third of February.
The court thetn gave tho state three
minutes for consultation.
Slate Closes.
After being out In the jury room for
a very short tlm6 the attorneys for the
state returned' and announced that
the state closed. This was exactly at
9; 32 o'clock.
Tho court then asked the defence If
there was anything further from them
and Mr. Hardwlcke replied yes whore
upon he read a portion of tho testimo-
ny of Claude Sears as it was taken at
Albany. After this W. J. Cunningham
of the defeimo was placed on the stand
and told of his talk with H. B. Manly
Mr. Cunningham Btated that Manly
did mention Barnett telling him nbout
buying some cattle from. Sears. The
prosecution objected to this part of
the testimony and tho court Instructed
the jury to not let this have any
weight as it was only Introduced to
Impeach tho testimony of Manly and
would have no bearing on tho case.
Defense Closes.
With this tho defense announced
that they had closed Court then in-
structed the witnesses to go to tho dis-
trict clerk's office nnd thoy would pet
the rl fee slips. However tho charac-
ter witnesses would not be' allowed a
fee. With this the court dismissed all.
witnesses connected with the case and.
told them they would hnvo tho entire
east section of tho court room reserv-
ed for their benefit during tho argu-
ment of the attorneys tomorrow. -
"Judge your honor" said Sam Ed-
1ns holding up Ills right hand "was I
a chracter witness?"
"I don't know replied the judgo
you will have to see the clerk about
that."
