with the case of W- C. Condor vs. the
Abilene and Northern railroad com-
pany suit for damages caused by an
overflow still on trial. The case oc-
cupied all of yesterday's session and
will likely not be concluded before to-
night. There are eight companion cas-
es to this which are to cpme up at
this term.

Au Ordinance prohibiting the burning
of paper trash aud waste matter
upon open lots and the streets and
allejs and public highways within
the Arc limits of the city of Abilene
Texas aud fixing a penalty for "vi-
olations thereof; and declarlug on
emergency.
Re It ordained by the City Council
of the city of Abilene;
Sec. 1. That It shall be unlawful
for any person to burn paper trash
or other waste matter upon any street
alley public highway or open lot
with the Hre limit's of the City of Abi-
lene Texas.
Sec. 2. Any person violating the
provisions of this ordinance) shall be
deemed guilty of a misdemeanor and
upon conviction thereof In the Corpo-
ration Court of the City of Abilene
shall be fined in any sum not less
than Five Dollars nor more than Fifty
Dollars.
Sec. 3. The fact that the burning
of paper trash and other waBte mate-
rial Is hazardous to the business prop-
erty of tho City of Abilene within said
limits creates a public necessity that
the rule requiring ordinances tq be
road on three separate meetings bo
and the same Is hereby suspended
and this ordinance shall take etfect
from and after its passage and pub-
lication as required by law.
