FORT WORTH Aug. 5 The circu
lation of a petition addressed to Pres-
ident Taft and asking for the pardon
of Ben Kllpatflck from the federal
prison nt Leavenworth through more
than thirty Western counties of Texas
will probably add a last chapter to
one of the most Intangible cases the
secret Bervlce wisdom has ever been
matched against. The arrest and sen-
tence of Kilpatrtck to prison grew out
fit the robbery ot a Montana express
train thirteen years ago. when moro
than $100000 in United States securl-
tlpB were stolen.
Although part of the money was
recovered when Kilpatrick was arrest-
ed a year later in St Louts In com-
pany with a Texns woman the mys-
tey concerning the grent holdup has
never to this day been solved. Wheth
er Kilpatrick wob really Implicated In
the daring game no one.ever knew but
the fact that several thousand dollars'
worth o the money was found in his
possession warranted the St Louis
courts in rendering a conviction and a
sentence of twenty years resulted.
Deputy Sheriff Sam Grayson of Tom
Green county In Fort WOrth Thurs-
day declared that the petitions hnd
several thousand signers including
many of the most promlnont cattlemen
and -politicians of the state. Several
Fort Worth livestock men Joined In the
request to the President for clemency
Ben Kilpatrick Is a comparatively
young looking man yet although since
1900 be has beon confined behind pri-
son walls He has relatives residing
in the Pecos country and he was
brought uy on a Knickerbocker Texus
ranch
When In 1899 the federal officers
after tracing the currency stolen from
tUe Montana train from Texas to St.
Louis arrested Kilpatrick at a St
Louis hotel they thought they had a
clew to the whereabouts of Jhe train
robbers but despite the' fact that much
circumstantial testimony was intro-
duced against. Kilpatrick: at the trial
la an effort to connect him with the
work he was liberated and later ar-
raigned on the charge ot passing spur-
ious money. The currency taken from
the express train was consigned from
Washington to a Montanax bank and
was not signed. KHNrlck t is al-

leged secured the nanies of the pi es-
ident and cashier of the bank and at-
tached their signatures to the money.
A grip taken from his room at a St
Louis hotel following his arrest was
packed full of these bills.
Kilpatrick was charged with circu-
lating the bank notes not only in sev-
oral towns through West Texas but
Fort Worth as well. It was six
months after the data of the robbery
that the notes first made their appeai;
nnco In public. Others were clrcu-
latlng(them as Well as Kilpatrick it is
alleged and although several others
were arraigned on similar charges it
developedjthat they1 had secured tlic
money from Kilpatrick.
