a fifteen-year-old messenger employ-

dent Roosevelt arrived here Wednes-
day morning from Colon and was re-
ceived on landing at 8:50 by Governor
Wlnthrop and other prominent Insular
officials. The town which was pro-
fusely decorated In the president's
honor was crowded with people from
the surrounding country eager to greet
Mr. Roosevelt.

Austin Nor. 21. Judge Brooke con-
vened court at :S0 o'clock Wednesday
morning In the Waters-Pierce Oil com.
pany anti-trust hearing. Judge Penn
reaumed his argument for the defense
again taking up the act of 1903 and lta
defective caption In connection with
the right of the state to protect pend-
ing suits under the act nf 1899. and
that the caption failed to mention this
portion of the act. On thla account he
believed that the act Is Invalid. Aa to
the charges of conspiracy In the pet.
tlon Judge Penn directed the attention
of the court that It was purely a con-
clusion; that facts were not properly
put In petition: that It waa a bare
statement and facta should show
whether or not conspiracy waa unlaw-
ful. Judge Clark began his argument at
11:20 saying that he vaoold not re-
view those points already decided by
the courts. He was of the opinion
that the petition as a whole failed to
ahow that defendant haa acted In dis-
obedience to the laws of the state;
that It was confronted on the threhold;
that lta obendtence to laws waa fraud
and deception; that Texas la only a
component part of the country and
that It haa no extra territorial Juris-
diction such as Including acts In oth-
er states. Said Judge Clark: "The
petition charges us with being an al-
leged corporation. If w are an al-
leged corporation why did the atate
aerve our agent? Hut we are a cor-
poration and we atand ready to an-
swer any charge aa to violation of
law."

act of 1899 waa unconstitutional aa It
waa discriminatory In that It exempt-
ed certain rlaasea.
He called attention to the Farmers'
Union and cotton association making
agreements to regulate the' price of
cotton. He wanted to know why the
attorney general and hla young as-
sistants were not prosecuting them.
He aaid the exemption of 189 ex-
placed officers of the state are not
prosecuting this form of combinations.
BISHOP TIGERT DEAD.
After an Illness of Ten Daya Methodist
Divine Passes Away.
Tulsa I. T. Nov. 21.-After an Ill-
ness of ten days Bishop John J. Tl-
gert of the Methodist Episcopal
church. South departed this life aned
forty-five years. The end came nt
R:4j o'clock Wednesday nicrnlng.
A three-lnrh chicken bn which the
bishop swnllowed caused a severe
throat t rouble.
The depnrted divine was born and
reared at Imlsville. Ky. Ills father
was a contractor of that city and the
bishop drove a wagon for four year.
In this way he earned enough money
to educate himself. He was graduated
at Vanderbllt university and became a
clergyman. At the last Methodist gen-
eral conference held last May In
Birmingham he was elected a bishop.
Bishop Tlgert left Ixulsvllle three
weeks ago to hold the Indian Terri-
tory conference at Tulsa. It waa hla
purpose to also hold conferences at
Fort Worth and Bonham.
MANY INJURED.
Fast Mall Train Crashes Into Another
One With Serious Results.
Mobile. Nov. 21. Fast mall train
No. 2. northbound on the Mobile and
Ohio railroad while on a aiding at
Dwlght. Ala. fifty miles north of Mo-
bile was crashed Into by southbound
fast mall train No. 3. Both engines
and trains were badly damaged and
twenty five or thirty persons Injured
all slightly. The wreck was caused
by the kagman becoming confused In
his orders and opening the switch
ahead of the northbound train throw-
ing the southbound train from the
main line Into the other train on the
siding.
The wreck was caused by the porter
of train No. 2 carelessly leaving open
n ewluh. Seeing a wreck was going
to occur lie took to the wood.. Pas
seirri rs of both trains were wrought
up and threatened to lynch him

cided nt Orr by shooting himself In
the head with a pistol.
Jo Haas formerly of Fort Worth
died from pistol shot Inflicted about
two weeks nco. No arrest has been

Zack Mulhall Is to Have a Rehearing
at St. Louis.

the well known southwest cattleman
and wild west showman who was sen-
tenced to serve two years In the penl-
tentlary for shooting a bystander In a
hooting affray on the pike during the
World's fair has been granted a re-
hearing In the rrimlnal court of St.
Louis by the supreme court.
